AN ORDINANCE approving Change Order No.
1 FOR RES. 6221-91, TURTLE
CREEK/STARDALE PAVEMENT RESTORATION with
MERGY CONSTRUCTION COMPANY in connection
with the Board of Public Works of the
City of Fort Wayne, Indiana.
NOW, THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF FORT WAYNE, INDIANA;
SECTION 1. That Change Order No. 1, RES. #6221-91,
DNHWO01NdOBM ) R TURTLE CREEK/STARDALE PAVEMENT RESTORATION with MERGY
CONSTRUCTION COMPANY in connection with the Board of Public
Works and Safety, for:
was necesary due to an unrelated (storm
sewer) pavement failure occurred within
the scope of project limits. An
emergency situation was at hand and was
considered "hazardous" to both pedestrian
and vehicular traffic. Repair resulted
in an increase which is reflected
accordingly;
involving a net increase of Sixteen Thousand One Hundred
Sixteen and 91/100 Dollars ($16,116.91), all as more
particularly set forth in the specifications, and which is on
file with the Office of the Board of Public Works and is by
reference incorporated herein, made a part hereof, and is
hereby in all things ratified, confirmed and approved.
SECTION 2. That this Ordinance shall be in full force
and effect from and after its passage and any and all

SYNOPSIS OF ORDINANCE: Change Order #1, Res. 6221-91, Turtle
Creek/Stardale Pavement Restoration was necessary due to an unrelated
(storm Sewer) pavement failure occurred within the scope of project
limits. An emergency situation was at hand and was considered "hazardous"
to both pedestrian and vehicular traffic. Repair resulted in an increase
which is reflected accordingly. Mergy Construction is the contractor.
EFFECT OF PASSAGE: Additional pavement replacement was substantial.
Failed areas are now properly restored and pose no hazard to the general
public.
