The Inshore Fishing’ (Scotland) Act 1984 allows conservation measures to be introduced, by means of an Order. Before a new Order can be made under the 1984 Act consultation with the industry is necessary. This recently took place for various measures but as a result of that exercise it was brought to our attention that there was a need to look closely at shrimp fishing activity in the Solway Firth. 2. The enclosed paper sets out the present position and lists the type of measures being contemplated. This consultation paper is being circulated widely to interested parties and comments on the proposals are invited by 4 December 1992. Any views or comments should be sent to me. INSHORE FISHING (SCOTLAND) ACT 1984 SOLWAY FIRTH SHRIMP FISHERY Background 1- As a result of the recent consultations on the proposed measures to be introduced by order under the terms of the Inshore Fishing- (Scotland) Act 1984 the Department received strong representations about the need to control shrimp fishing in the Solway Firth. This was not one of the subjects discussed in the consultation document but, having considered the views expressed, it is felt that there may be a case for introducing certain controls. This is particularly relevant at this time because the Cumbria Sea Fisheries Committee are proposing to introduce new ( regulations in the form of byelaws covering their area in English waters. As there has been an increase in twin rigged beamers working continuously in the Solway Firth, local fishermen feel that the present fishing effort could destroy the fishery and that measures must be introduced in the interest of conservation and to keep the fishery viable in the future. Proposals 2. The following measures may be appropriate (although not all of them could be introduced by an Order under the 1984 Act) - : 2.1 when fishing for shrimps the beam trawl length should not exceed 6 metres and in the case of an otter trawl, the length of headline should not exceed 6 metres. 2.2 No more than one beam trawl should be used at any one time when fishing for shrimps unless the aggregate length of the beams does not exceed 6 metres. 2.3 To limit destruction of immature fish every person fishing for shrimps should as soon as practicable after each haul, thoroughly sift the catch in a riddle having a mesh such that spaces between adjacent longitudinal wires are not less than 7mm and the spaces between the adjacent lateral wires is to be not less than 76mm. 2.4 Immature sea fish which pass through such a riddle should be returned to the sea forthwith. 2.5 No person should fish for sea fish in Scottish waters within the Solway Firth from any mechanically propelled vessel with a registered engine power exceeding 280 BHP except with hooks and lines. Timetable 3. It is intended that where controls can be introduced in terms of the Inshore Fishing (Scotland) Act 1984 they should be included in the Order presently being prepared, to come into force from 1 January 1993.
