File-notings on movement of this RTI-petition Learned CPIO vide a delayed response No. 241l26/2014-Public dated 18.03.2014 in response to query (17) declined information as they are 'secret' by nature! Documents being marked 'secret' and confidential' are not at all exempted under RTI Act, and are being regularly provided by concerned public-authorities including even Prime Minister's Office (PMO). Otherwise also section 8(2) ofRTI Act provides access to information where public-interest overweighs harm protected. It is necessary to know working of MHA and Padma Awards Committee (PAC) which have been clearing controversial names which are even not fit to be cleared by Intelligence Authorities. Even in past controversial names like wilful bank-defaulters (Arun Firodia) and of those involved in criminal cases (Saif Ali Khan) have been cleared not only by MHA and PAC but even by Intelligence Authorities putting a big question-mark on proper recommendations by PAC and their subsequent clearance by Intelligence Authorities. I appeal sought information under query (17). may kindly be directed to be provided but now free-of-cost under section 7(6) ofRTI Act. Learned CPIO in response to query (24) a~mitted that some informal objections were received at MHA on some Padma-awardees of the year 2014, but without having some consolidated data maintained in this regard. Evidently information in some form or other does exist at MHA. I never asked information in some particular format. I appeal that information may kindly be directed to be provided in the form and manner existing at MHA and/or any other concerned public-authority but now free-of-cost under section 7(6) ofRTI Act. Likewise learned CPIO in response to query (26) admitted information existing at MHA, but declined to provide as 'internal process' of the ministry! RTI Act does not exempt information because of being some 'internal process'. In fact, what the CPIO has termed as some 'internal process' is the real information allowable underRTI Act. No better example of hiding information can be there. I appeal learned CPIO may kindly be directed to be provide information to query (26) but now free-of-cost under section 7(6) of RTI Act. I in my very initial paragraph requested to provide information to various queries together with related file-notings/correspondence/documents etc. I appeal file-notings/documents/correspondence relating to selection of members of search-committee and awards-committee may kindly be directed to be provided but now free-of-cost under section 7(6) ofRTI Act.
