OperatingPermitNo.00100 Amendment002 ConsolidatedClosurePlanModifications May10,2001 I. IntroductionandBackground TVXMineralHill,Inc.(TVX)producedgoldattheMineralHillMinenearJardine, ParkCounty,Montana,underOperatingPermitNo.00100,from1989through September1996. TheoriginalpermitwasissuedonFebruary14,1988. Since then,oneamendmentand19modificationshavesupplementedthepermit. The permitcovers424acres. Thesiteconsistsofthemine,processingfacilities,the JardineHistoricDistrict,andthetailingsstoragefacility. Atotalof69acreshave beendisturbedtodateaspartofOperatingPermit00100. TVX,throughitsmineoperatorAmerikanuak,Inc.,planstoreclaimtheminesite completely. TVX,initsConsolidatedClosurePlan(CCP),proposestomodify theapprovedreclamationplan.Therevegetationplanwouldalsobemodified. Thetailingsstoragefacility(TSF)wouldreceivea48-inchwaterbalancecap, insteadofthecurrentlyapproved15-inchwaterbarriercapovera9-inch compactedbentonite-amendedlayeroftailings. Anyseepagethatwould eventuallyreachtheTSFunderlinerwouldbetreatedinabiologicaltreatment systemandhabitatdevelopmentsite,insteadofinareverseosmosisplant. ThemajorityofthewaterfromtheCreviceAditwouldbeconveyedinaburied pipelinetoBearCreek.TheCreviceAditwatermeetsallwaterqualitystandards. Upto50gpmofthewaterfromtheCreviceAditwouldbeconveyedtoastorage tankforpotentialdomesticuseandfireprotectionintheJardinearea. The1300Aditwaterwouldbetreatedinachemicaladditionbuildingwithferric sulfatetoremovearsenicandthendischargedtotheexistingsepticdrainfields. TheDraftandFinalEnvironmentalImpactStatements(EIS)examinetheimpacts oftheCCPandalternatives. TheMontanaDepartmentofEnvironmentalQuality(DEQ)mustdecidewhether topermittheCCPandwhatmitigationmeasurestoimposetoreduce environmentalimpacts. DEQmustalsodecideonrevisionstotheMontana PollutantDischargeEliminationSystem(MPDES)PermitNo.MT-0030252for TVXConsolidatedClosurePlan-RecordofDecision 1 waterdischargestoBearCreekandgroundwater. Thesedecisionsare documentedbelow. II. Decisions Afterconsideringtheproposal,issues,alternatives,potentialimpacts,public commentsandmanagementconstraints,DEQhasselectedtheAgency ModifiedPlan. Theproposedaction,asmodifiedbyDEQ,isapprovedfor implementationasdescribedinthisRecordofDecision(ROD). Mitigationmeasurestoreduceenvironmentalimpactsandtoimprovethe potentialforlong-termreclamationsuccesswillbestipulatedtoAmendment002 totheoperatingpermitbeforethisdecisioncanbeimplemented. Thisapproval isgivenundertheauthorityoftheMetalMineReclamationAct(MMRA). The Applicant’sProposedPlanandtheAgencyModifiedPlanaredescribedin detailinChapter2oftheDraftEIS. III. Amendment002Stipulations Stipulation100-002-01:TVXmustconstructthetailingsstoragefacility(TSF) tforreartemveinetwsaynsdtaepmpsroavnadlpbiepfeolrineeismipnle2m0e0n1ta.tTioVnX.mIufstthesTubSmFitsfeienapladgeesibigonlsogtiocaDlEQ treatmentsystemisshutdownforrepairsormaintenance,TVXmustimplement thefollowingcontingencyplans.InQptionA,whichisthefirstcontingencytobe implemented,TVXmustaddupto184gpmofCreviceAditwatertotheTSF seepagepipeline,tomeetthegroundwaterarsenicstandardof0.02mg/I,before thewaterenterstheuplandhabitatdevelopmentsite(HDS). Themixedwater mustbemonitoredbeforeitenterstheuplandFIDS. IfOptionAisnotimplementableforanyreason,TVXmustimplementOptionB. InOptionB,TVXmustaddupto200gpmofCreviceAditwatertotheTSF seepageinthewetmeadowFIDS. OverflowfromthewetmeadowFIDSmust reporttoanephemeraldrainagefordischargeintoBearCreek. Thequalityof theoverflowmustbemonitored,andthemixtureofCreviceAditwaterandTSF seepageadjustedtomeetrequirementsoftheMPDESpermit. AnewOutfall A00p6pemnudsitxbDeaofddtheedDtroafttheEIMSPfDorESacpoenrcmeitp.tuaSleedrFaiwgiunrgeo1f,tOhpeticoonnstiAngaenndcyBpilnans. Rationale:ThesecontingencieswillensureimpactsfromTSFseepagewillbe preventedifthetreatmentsystemisshutdownforrepairsormaintenanceand willensurecompliancewithwaterqualitystandards. An additionalwaterqualitymonitoringstationmustbeestablishedtomonitorthe TVXConsolidatedClosurePlan-RecordofDecision 2 effluentfromthechemicaladditionbuildingaftertheferricsulfateadditionand mixing. Monitoringmustalsobeperformed12timesperyearinthedosingtank beforedischargeofwatertothedrainfields. Twocontingencieshavebeendeveloped. InOptionC,ifthetreatmentsystemis downforrepairsorreplacement,TVXmustmixupto190gpmofCreviceAdit waterwiththe1300Aditwaterpriortodischargetogroundwater.TVXmustalso burytheexisting1300AditdischargepipelinetoBearCreek. InOptionD,ifthe ferricsulfatecoprecipitationsystemneedsmaintenanceorrepairs,CreviceAdit watermustbemixedwiththe1300AditdischargeandOutfalls003and001 must beused.SeeFigure1,OptionsCandDinAppendixDoftheDraftEISfora conceptualdrawingofthecontingencyplans. Rationale:Thesecontingencieswillensureimpactsfrom1300Aditdischargewill bepreventedifthetreatmentsystemisshutdownforrepairsormaintenanceand willensurecompliancewithwaterqualitystandards. Stipulation100-002-03:TVXmustconstructthenewCreviceAditwatersystems ibnef2o0r0e1c.onFsitnraulctdieosni.gnTpVlXanwsomuulsdtbbeersequubimrietdtetdofuosreatgheencCryerveivcieeAwdiatndwaatpeprroinval othercontingencyoptionsifneededfortreatmentofTSFseepageorthe1300 Aditdischarge. Rationale:ThisuseofCreviceAditwaterwillensureimpactsfromthe1300Adit dischargeandTSFseepageareprevented. Stipulation100-002-04:TVXmusthireaminedlandrevegetationspecialistto preparearevisedrevegetation,revegetationmonitoringandnoxiousweed monitoringandsoilamendmentplanbasedonrecommendationsinAppendixB intheDraftEIS. Therevegetationplanmustincludearevisedseedmixand seedingrateforthesitethatwouldfavorsurvivaloftreeandshrubspecies,allow naturalinvasionofothernativespecies,andcontrolerosion. Theplanwould includemoretreeandshrubplantingontheslopesoftheTSF.Theplanmust ensureadequatemeasuresaretakentoguaranteedominancebytreesand shrubs,especiallyontheTSF. Thisrevegetationmonitoringplanmustspecifythemethodologiesforannual measurementstobeemployedinthemonitoring,lengthofmonitoringand reportingfrequency. Monitoringmustincludevegetativecanopycover, production,andspeciesdiversity,woodyplantsurvival,soilmicrobecommunity dynamics,soilfertility,noxiousweedcontrol,invasionbyothernativespecies anderosion. Ifvegetativecanopycoverandspeciescompositiononrevegetated areasarelessthantheEcologicalDynamicSimulationmodel’s(EDYS)second yearpredictions,TVXmustproposeandimplementremedialvegetation enhancement. TVXConsolidatedClosurePlan-RecordofDecision 3 TVXmustcontinuetomonitorandcontrolnoxiousweedsonrevegetatedareas atleastuntiltheDouglasfirseedlingsarewellestablished. Spotsprayingmust beusedforweedcontroltopreventinjurytodesirabletreesandforbsthat becomeestablished. Therevegetationspecialistmustproviderecommendationsforfertilizerand organicmatteramendmentsandapplicationrates.TVXmustusewoodwaste organicamendmentsforareastobedominatedbytreesandshrubs,especially ontheTSF. TherevisedplansmustbesubmittedtoDEQbeforerevegetationcommencesin 2001. TVXmustfencetheTSFtoprotecttheshrubsandtreesfrombrowsing animalsuntiltheyaresuccessfullyestablished. Rationale:Theseplansareneededtoensurerevegetationsuccess.The revegetationplanwillhelpprovideforthetimelyestablishmentandlong-term survivalofvegetationforerosionandseepagecontrol. Thesemeasureswillhelp encouragemoreDouglasfirsurvivalandgrov\rthandnaturalinvasionbyother nativespecies. Dominanceofdeep-rootedDouglasfirontheTSFwillreducethe long-termpotentialforwaterqualityproblemsfromTSFseepagebyremoving waterfromthewaterbalancecapthroughevapotranspiration. Adensestandof treeswillreducelong-termnoxiousweedsurvivalontheTSF. Theuseofwood wastewillhelpensuredominancebyDouglasfirandreducethelong-termriskof noxiousweedinvasionontheTSF. Monitoringwillensureproblemsareidentifiedsomodificationscanbemadeas needed. Stipulation100-002-05:TVXmustmonitorflowsatthespringabovetheOld TailingsNortharea. Rationale:Thisstipulationwillensurethatthe1300Aditdischargebeingadded tothesepticsystemdoesnotexceeddrainfieldcapacity. Stipulation100-002-06:TVXmustsampleforthiocyanateintheTSFseepage beforeandafterthebiologicaltreatmentsystemuntiltheagencyagreesthat thiocyanateconcentrationsarenotaproblem. Rationale:Thiswillensurethatthiocyanatedoesnotkillthevegetationinthewet meadowHDS. Stipulation100-002-07:TVXmustsubmitareviseddetailedmonitoringand maintenanceplanupdatingtheCCPtoreflectaccuratelythechangesmade throughtheEISandthisROD. ThisplanwillbeduetoDEQbytheendof2001. TVXConsolidatedClosurePlan-RecordofDecision 4 Rationale:ThesechangesupdatingtheCCPwillmakethemanenforceablepart ofOperatingPermit00100. Stipulation100-002-08:TVXmustprovidereplacementpagesfortheCCP documentincorporatingallstipulationsaspartoftheCCPrequirements. Rationale:IncorporationofthestipulationsintotheCCPmakestheman enforceablepartofOperatingPermit00100. Stipulation100-002-09:IfTVXdoesnotcompleteconstructionofthewater treatmentsystemsin2001,thenDEQwillbondfortheirconstruction. Rationale: TVXhasconstructedportionsofthewatertreatmentsystems. TVX hascommittedtoconstructtherestofthetreatmentsystemsin2001. DEQhas notbondedforthedirectcostsofconstruction. Thisstipulationwillensurethat thetreatmentsystemswillbebondedifTVXdoesnotcompleteitsperformance schedule. Stipulation100-002-09:IfTVXconvertstheletterofcredittoasuretybond,then DEQwillrecalculatethebondcostsassociatedwithInterimMaintenanceand Shutdown. Rationale:DEQhasnotincludedtheextracostsassociatedwithcollectinga suretybondinthebondcalculations. Aletterofcreditisamuchmoreliquid financialinstrument. ThisstipulationensuresthatDEQwouldhavetheabilityto bondforextramoneytocollectonthesuretybond. IV. Implementation ThisdecisioniseffectiveuponsigningofthisRQD. TVXmayimplementsurface disturbingactivitiesimmediately. Thereclamationperformancebondmustbe submittedtoDEQwithin30daysofthisRQD. A. OtherRightsandPermits Approvalofthepermitamendmentdoesnotconveyorcreateanyrealproperty rightsoruserights. TVX’sStormWaterPollutionPreventionPlan(SWPPP)wasapprovedunder GeneralDischargePermitforStormWaterAuthorizationMTR300232. TVXalso holdsAuthorizationtoDischargeundertheMontanaPollutantDischarge EliminationSystem(MPDES)MT-0030252. TVXholdsAirQualityPermit#2087-06. TVXConsolidatedClosurePlan-RecordofDecision 5 TVXisresponsibleforobtaininganypropertyrights,easements,mineralrights, orwaterrightsnecessarytoimplementtheoperatingpermitamendment. TVXis responsibleforobtaininganyotherlocal,state,orfederalpermits,licenses,or reviewsthatmightbenecessarytoimplementtheoperatingpermitamendment. Duringimplementationofthisdecision,TVXmayproposewaivers,exceptions,or modificationstothereclamationplansandassociatedstipulationsorconditions. Suchchangescouldbeappropriatetoallowtheuseofalternatemitigation methodsthatmightbedevelopedinthefuture,ortorespondtoanimproved understandingofsiteconditionsgainedthroughoperationalexperience. Anyproposedchangestotheoperatingprocedures,schedule,reclamation design,ormitigationmeasureswillbereviewedbyDEQandacceptedifthe changewouldprovideresourceprotectionequaltoorgreaterthantheoriginal requirement,andwouldnotresultinsignificantimpactsnotidentifiedintheEIS. Proposedchangesthatwouldnotachievethesamelevelofresourceprotection, orwouldresultinpreviouslyundisclosedsignificantimpacts,wouldrequire supplementalenvironmentalanalysispriortodeterminingtheiracceptability. B. ReclamationBond Areclamationbondistobepostedandmaintainedinanamountthatwould enableDEQtoimplementthereclamationandotherplansasstipulatedabove andinprioramendmentsshouldTVXbeunableorunwillingtodoso. The reclamationbondmaybepostedincrementallyorreleasedtoreflectstagesof performanceofreclamation,butwillalwaysremainatanamountadequateto payforthereclamationofanydisturbancethatmightexist. ThebondisreviewedonceayearbyDEQaspartofanannualbondoversight processrequiredbytheMMRA,Section82-4-338,MCA. Theentirereclamation costestimatewillbereviewedandadjustedbyDEQatleastevery5yearsas requiredbytheMMRAtoaccountforchangesinreclamationcostsandinflation. Thepublicwillbenotifiedoftheresultsofthe5-yearbondreviewprocessand anyproposedbondreleasesandwillbeprovidedtheopportunitytocomment. ThereclamationbonddoesnotrepresentthelimitsofTVX’sliabilityshould actualreclamationperformancefailtomeettherequirementsinthereclamation planorcomplywithenvironmentallaws. IncomplyingwiththefullextentoftheMMRA,Section82-4-338,areclamation bondhasbeenestimatedfortheMineralHillMinereclamationplan. Basedupon theinformationsubmitted,thebondhasbeenestimatedat$3,348,000for reclamationactivitiesand$5,189,000forwatertreatment,foratotalof $8,537,000. Interestratesorindicesusedtocalculatethebondamountsmay changewithtime. Therefore,anybondamountsusedintheRQDaresubjectto changeovertime. TVXConsolidatedClosurePlan—RecordofDecision 6 Thisbondestimatehasbeenpreparedfortheselectedalternative(seeattached BondSummarySheetinAppendixROD-A). Provisionsinthestipulationsare includedaslineitemsandcontingencieswithinthebondasneeded. Supporting detailsofthebondingsummaryareavailablefromDEQ. Lineitemspreparedby theDEQtodeterminethetotalamountoftheletterofcreditbondrequiredare notlimitationsonhowtheDEQmayspendanyofthebondproceedsfromthe letterofcredit. Thisbondestimatehasbeendividedintospecificitems: (1) Faabcainlidtoinesedinecqluudiepsmecnoltleacntdingmaatenrdiadliss,podseimnogliosfhpientgrsotlreuucmtuwraesstae,ndremoving removingdebris,recontouringthefacilitiesareaandotherbuildingsites, haulingandspreadingsoil,andestablishingvegetationandweedcontrol. (2) TailingStorageFacilityincludesconstructingdiversionditchesandhaul roads,constructingthewaterbalancecap,andestablishingvegetation andweedcontrol. (3) OldTailingsSouthincludesestablishingvegetationandweedcontrol. (4) Roadsincludesreclaimingroads. (5) UndergroundOpeningsincludesclosingthe1050LevelPortal,closing the1200LevelPortal,backfillingventandfillraises,closingthe610Level Portal,andreplacingbatgratesattheLastChancePortalandCrevice Adit. (6) DevelopmentRockPilesincludesregrading,placingtopsoil,seedingand weedcontrolonTopofMineralHill,the450LevelDump,andthe750 LevelDump,reclaimingthe1050LevelDump,reclaimingthe1200 Level/34000TonDump,regrading,placingtopsoil,seedingandweed controlonthe13038TonDump,andreclaimingthe610Level“Crevice” Dump. (7) Miscellaneousincludessurveyingandstaking,abandoningseptictanks, reclaimingthealluvialmaterialsourcesite,abandoningwaterlines, cleaningupandseedinglaydownsites,reclaimingtopsoilstockpileareas, andinstallingafencearoundtheTSF. (8) InterimMaintenanceandShutdownincludesattorneyfeesformanaging letter-of-creditbonds. TVXConsolidatedClosurePlan-RecordofDecision 7 (9) SiteManagementDuringReclamationincludesretainingathird-party engineeringfirmtomanagethesite,includinglabor,power,insurance, taxes,leases,vehicles,computers,etc. (10) WaterTreatmentincludesthecostsofwatermonitoring,MPDESpermit, wellabandonment.Well#10remediation,TSFseepagebiological treatmentsystemandwetmeadowanduplandHDS,TSFseepage dischargecontingencies,1300Aditdischargechemicaladditionsystem andseptictank,1300dischargecontingencies.CreviceAditwatersystem, andtemporaryreverseosmosistreatmentplant. OthercostsassociatedwiththereclamationoftheMineralHillMineinclude contingencies(5%),mobilization(5%),engineeringdesign(5%),agency administration(5%),andinflation(3%over5years,or16%). Asnotedabove,TVXmayimplementthedecisionimmediatelywhentheRODis signedandTVXreceivestheOperatingPermit00100,Amendment002approval form. Thebondmustbesubmittedwithin30daysaftertheRODissigned. Thefinalbondamountincludesreclamationcostsassociatedwithdisturbance createdbyTVXunderExplorationLicense00559. Oncethenewbondisposted andapprovedbyDEQ,DEOwouldreleasetheexistingexplorationbondletterof creditandplacetheexplorationlicenseinactive. BondreleasemayberequestedincrementallybyTVXascompletedactivities meetthereclamationstandardsoutlinedinMMRA. Whenbondreleaseis requested,DEQwillevaluatetherequestandsolicitpubliccommentasrequired bySection82-4-338,MCA,priortomakingadecision. V. IssuesandAlternatives TheEISandthisRODhavebeenpreparedinresponsetoTVX’sapplicationand issuesandconcernsidentifiedthroughpubliccomment. Analternativewas developedtoaddresssignificantissues. Theseissuesandthealternativeare summarizedbelowandpresentedindetailintheDraftEIS. Thepreferred alternativeidentifiedintheDraftEISistheAgencyModifiedPlan. This alternativehasalsobeenselectedforimplementationfollowingpreparationofthe FinalEIS. Thisdecisiontookintoaccounttheimpactsofthealternativesaswell aspubliccommentandthepotentialforthealternativestoresolvetheissues. PublicScopingandComments AnoticewassentoutonMay24,2000,announcingthepublicscopingmeeting. ThescopingmeetingwasheldinGardineronJune15,2000. Sixpeoplesigned theattendancelist. TVXConsolidatedClosurePlan-RecordofDecision 8 TheDraftEISwasreleasedFebruary13,2001. TheDraftEISpresentedthree alternatives,includingthenoactionalternative,TVX’sproposedaction,andthe preferredalternative. TheDraftEISdisclosedtheaffectedenvironmentandthe environmentalconsequencesofeachalternative. ApublichearingwasheldinGardineronMarch7,2001,toreceiveoral commentsontheDraftEIS. Twentypeoplesignedtheattendancelist. Four peoplepresentedcomments. Thirteenlettersande-mailmessageswerealso received. ThepublicreviewperiodendedonMarch20,2001. AllcommentswerereviewedandconsideredduringpreparationoftheFinalEIS. Commentsthatpresentednewdata,questionedfactsoranalysis,orraised questionsorissuesbearingdirectlyonthealternativesorenvironmentalanalysis receivedaresponseintheFinalEIS. Commentsexpressingpersonalopinions wereconsideredbutdrewnoresponse. AbondreleasehearingwasheldonApril26,2001 inGardiner. Sixpeople attendedthehearing. Commentsreceivedonthebondwereusedtocalculate thefinalbondamount(SeetheattachedTableH-1 FinalBondSummarySheet inAppendixH). AlsoseeAppendixHfortheresponsestopubliccomments receivedatthebondhearingandfromlettersreceivedduringthebondrelease commentperiod. A. IssuesandAlternativeDevelopment AppendixAoftheDraftEISdescribestheissuesraisedbyagencyspecialists andthepublic. Significantissuesthatreceiveddetailedstudyaredescribedin Chapter2oftheDraftEISandaresummarizedbelow. Issue1. TailingsStorageFacility(TSF1-BiologicalTreatmentSystem.Cap Design ResidualdrainagefromthereclaimedTSFwouldcontinueindefinitely. The existingapprovedplandoesnotincludewatertreatment. Theproposedaction wouldemployabiologicaltreatmentsystemandwetmeadowhabitat developmentsitethathasbeensuccessfulelsewhere. Concernshavebeen raisedregardingtheproposedTSFseepagebiologicaltreatmentsystemandthe effectivenessoftheproposedwaterbalancecapdesigninreducinginfiltration. EffectsfromtheTSFcapdesignalternatives,suchasrevegetationpotential,root penetration,treefall,fireandclimaticeffects,areofconcern. Long-termwater treatmentofTSFseepageisalsoaconcern. TVXConsolidatedClosurePlan-RecordofDecision 9 Issue3. CreviceAditWaterSystemDesign WaterdischargesfromtheCreviceAdittoOutfall001 arecurrentlypermitted underanMPDESpermit. ThreeoutfallstoBearCreekhavebeenpermitted. ThefirstisthedischargefromtheTSFunderdrainsystemfollowingtreatment. Thesecondisacombinedoutfallofthetwominedrainagesources:1)the CreviceAditwater,whichisofhighqualityandrequiresnotreatmentpriorto discharge,and2)the1300Aditwater,whichhaselevatedlevelsofarsenic,and isdischargedtoOutfall003. Thecombinationofthetwominedischargesresultsinnomeasurableimpactto BearCreekwaterquality. Proposedreclamationactivitieswouldmodifythe CreviceAditwatersystemdesigninthatthepipelinefromtheCreviceAditto BearCreekwouldbeburiedbelowfrostdepth. The1300Aditdrainageline wouldbeseparatedfromtheCreviceAditdrainageline. Concernshavebeenexpressedaboutthechangestotheexistingsystems becausethewatercurrentlymeetswaterqualitystandardsbeforedischargeto BearCreek. Issue4. 1300AditDrainaqe Undertheproposedplan,dischargeof1300AditwaterdirectlytoBearCreek wouldbeeliminated. The1300Aditdischargelinewouldbeseparatedfromthe CreviceAditwaterline,buried,andthedrainagetreatedinachemicaladdition buildingwithferricsulfateandroutedtotheexistingseptictank. Thetreated effluentwouldbedischargedfromthedosingtankintothetwodrainfieldsat Outfall005. Concernshavebeenraisedabouttheeffectivenessofthisproposedsystemand long-termcareandmaintenanceofthesystem. Issue5. Long-TermMonitoringandMaintenance Theproposedplancontainsalong-termmonitoringplandesignedtotestforthe successorfailureofreclamation. Fundingoftheongoingmonitoringand maintenancerequirementsisanimportantconsideration.
