Leigh Kienker- (415) 575-9036 leigh.kienker^sfgov.org ADOPTING FINDINGS RELATEDTO THE CERTIFICATION OFA FINAL ENVIRONMENTAL IMPACT REPORT, FILE NUMBER 2007.0128E, FORTHE PROPOSED DREW SCHOOLADDITION PROJECT ("PROJECT"). PREAMBLE On February 2, 2007, pursuant to the provisions of the California Environmental Quality Act (Cal. Pub. Res. Code Section 21000 et seq., hereinafter "CEQA"), the State CEQA Guidelines (Cal. Admin. Code Title 14, Section 15000 et seq., hereinafter "CEQA Guidelines"), and Chapter 31 of the San Francisco Administrative Code, hereinafter "Chapter 31", the Planning Department ("Department") received an Environmental Evaluation Application for the Project, in order that it might conduct an initial evaluation to determine whether the Project might have a significant impact on the environment. On March 8, 2008, the Planning Department determined that an Environmental Impact Report, hereinafter "EIR" was required and provided public notice of that determination by publication in a newspaper of general circulation and mailed a Notice of Preparation of an EIR to property owners within a 300-foot radius of the project site as well as neighborhood organizations for the project area. On March 10, 2008, the Notice of Preparation was received by the State Secretary of Resources via the State Clearinghouse (State Clearinghouse Number 2008032039), and was distributed to responsible State agencies for any comments. On October 8, 2008, the Department published the Draft Environmental Impact Report (hereinafter "DEIR") and provided public notice in a newspaper of general circulation of the availability of the DF.1R for public review and comment and of the date and time of the Planning Commission public hearing on the DEIR. www.sfplanning.nrg Motion No. 17879 CASE NO. 2007.0128E Hearing Date: May 14, 2009 2901 California Street/ 1831-1835 Broderick Street On October 8, 2008, copies of the DEIR, noting the date of the public hearing, were mailed or otherwise delivered to a list of persons requesting such notice and DEIR, and Notice of Availability of the DEIR, noting the date and time of the public hearing, was mailed to the balance of the notification list, including property owners within a 300-foot radius of the project site. On November 13, 2008, the Planning Commission held a duly advertised public hearing on said DEIR at which opportunity for public comment was given, and public comment was received on the DEIR. The period for acceptance of written comments ended on November 24, 2008. On November 19, 2008, the Landmarks Preservation Advisory Board held a publicly noticed informational hearing on the DEIR in order to provide comment from the Landmarks Preservation Advisory Board. These comments were subsequently prepared and received on December9, 2008. The Planning Department prepared responses to comments on environmental issues received at the public hearing and in writing during the over 45-day public review period for the DEIR, inclusive of the Landmarks Preservation Advisory Board comments, prepared revisions to the text of the DEIR in response to comments received or based on additional information that became available during the public review period, and corrected errors in the DEIR. This material was presented in the "Drew School Addition Comments and Responses" document, published on April 30, 2009, distributed to the»Planning Commission and all parties who commented on the DEIR, and made available to others upon request at Department offices. A Final Environmental Impact Report (hereinafter "FEIR") has been prepared by the Planning Department, consisting of the Draft Environmental Impact Report, any consultations and comments received during the review process, any additional information that became available, and the Comments and Responses all as required by law. Since publication of the DEIR, no new information of significance has become available that would require recirculation of the EIR under CEQA Guidelines Section 15088.5. Project Case File 2007.0128E has been made available for public review at the Planning Department offices at 1650 Mission Street, Suite 400, and its contents are part of the record before the Planning Commission. On May 14, 2009, the Planning Commission reviewed and considered the FEIR and hereby does find that the contents of said report and the procedures through which the FEIR was prepared, publicized and reviewed comply with the provisions ofCEQA, the CEQA Guidelines and Chapter 31 of the San Francisco Administrative Code. Findings 1 laving reviewed the materials identified in the preamble above, and having heard all testimony and arguments, this Commission finds, concludes, and determines as follows: 1. The above recitals are accurate and constitute findings of this Commission. 2. The Planning Commission hereby does find that the Final Environmental Impact Report concerning File No. 2007.0128E, Drew School Addition Project, reflects the independent SPALNAFRNANNCIINSCGO DEPARTMENT 2 Motion No. 17879 CASE NO. 2007.0128E Hearing Date: May 14, 2009 2901 California Street/ 1831-1835 Broderick Street judgment and analysis of the City and County ofSan Francisco, is adequate, accurate and objective, and that the Comments and Responses document contains no significant revisions to the DEIR, and hereby does CERTIFY THE COMPLETION of said Final Environmental Impact Report in compliance with CEQA and the CEQA Guidelines. 3. The Planning Commission, in certifying the completion ofsaid Final Environmental Impact Report, hereby does find that the project described in the Environmental Impact Report would have the following unavoidable and significant environmental impacts that could notbe mitigated to a level of non-significance: A. Demolition of a structure at 1831-1835 Broderick Street that appears eligible for the California Register of Historical Resources as a contributor to an eligible district under Criterion "C" (Architecture). B. Demolition of the structure at 1831-1835 Broderick Street that could contribute to potentially significant cumulative impacts on the eligible district, but not considerably. I hereby certify that the foregoing Motion was ADOPTEDby the Planning Commission at its regular meeting ofMay 14, 2009.
