The fourth edition goes even further. In addition to offering what is still a first rate introduction to shipping in all its aspects, it is a mine of information for students of traditional maritime law as well as for many others who seek to understandthe workingsofthe world’s maritime servicesingeneral andshipping services, in particular. As with previous editions, the fourth edition retains the originalpurposeofelucidatingandprovidinginformationonnationalandinterna- tionalpoliciesandpracticesonshipping,includingtheage-olddichotomybetween theconceptoffreedomoftheseasandthepersistentdemandsofStatestocontrol specific maritime areas, and the tension between, on the one hand, the claims of States to regulate and protect their shipping interests and, on the other hand, the abidingconcernandunquestionedrightoftheinternationalcommunitytoregulate the global shipping industry in order to ensure maritime safety, protection of the environment, and fair competition. But it also gives due attention to the many importantchangesthathaveoccurredininternationalshippingsincethepublication first appeared in 1987. Particular mention may be made in this regard to, among others,thesectionsthatdescribetheelaboratesystemofnationalandinternational technical rules and regulations designed to secure the safety of ships and lives at sea;thepartsdealingwiththeinterface ofshippingandprotectionoftheenviron- ment, including rules and mechanisms regarding liability for damage to the envi- ronment caused by the operation of ships; and the sections on emerging issues of maritime security, including measures to prevent and suppress unlawful acts that threatentheintegrityofinternationalshipping. Unlike previous editions, this edition is the result of collaboration between several contributors. Nevertheless, the principal editors have managed to merge the different styles and orientations into a homogeneous whole that successfully presentsacoherentpicture,withoutinanywaydisguisingthevarietyofapproaches thathavegoneintoit.Theresultisacompendiumthatprovidesausefulsourceof informationandinsightsintomanyofthecomplexanddevelopingproblemswhich v vi Foreword(FourthEdition) personsengagedorinterestedinvariousaspectsofshippingwilleitherencounteror deal with at one time or another. Clearly the book does not claim to answer all potentialquestionstothesatisfactionofeveryreader;butitcanatleastbesaidwith somejustificationthatithasraisedortouchedonthemainquestionsandissuesthat currentlyariseintheworldandbusinessofshipping.Forthatallwhoareengagedin shippingowetheauthorsandeditorsadebtofgratitude. Indeed,thispublicationshouldbeofinteresttotheglobalcommunityasawhole. Shipping plays an indispensable role in world trade and commerce because it provides the medium without which the movement of goods needed for interna- tional commerce would not be possible. It combines intellect with practicality and spans every aspect of life— today, as it always has done. It is the one sector on which the modern world depends—for our trade (what we buy in our high streets), our food (for which shipsareamajorpartofthesupplychain)andouressentialenergyresources.The challenges, complexities and excitement of our association with this life-essential arebothrewardingandaddictive,atalllevelsofactivityinvolvingtheseaandthe industrieswhichworkwithit. Theseademandsanelementalattachment,whichcanbedifficulttodescribeto thosewhodon’tseeorcomeintocontactwithit.Itinvolvesascaleandbreadthof visionandreality,whichshoutimportanceoutloud. Thisfourtheditionisthefirstsincetheoriginalauthorofthiswork,BruceFarthing, has died. The previous edition was already the product of a collaboration, but of necessity—withBruce’sencouragement—thisoneisevenmoreso.Italsoseeksto movethebookinaslightlynewdirection,takingitbeyondtheoriginalconceptofan introductiontothepolicyaspectsofinternationalshippingtoacombinationofthat purpose and a basic textbook for students and other readers entering the world of maritimeservices.Intheinternetera,somuchinformationisavailablethatwasnoton offerbefore,thatthisshiftofdirectionwasprobablyinevitable. ThefirstandsecondeditionswereBruce’salone.Theyweremuchslimmerand focusedveryspecificallyonwhatwasthenknownbytheterm“shippingpolicy”— freedomoftheseas,protectionism/liberalisation,tradeandcompetitionpolicy. The third (in 1997), edited principally and developed by Mark Brownrigg, retainedthespiritoftheoriginalbutre-orientatedandrestructuredthebook,adding newchaptersonbroaderaspectsofpolicysuchasshipregistration,safetyandthe environment.OutofrespectforBruce’svision forhiscreation,wehavereprinted theForewordandPrefaceofthethirdeditionaswell,forreaderstosee. In many ways, the range of international shipping policy issues has broadened againinrecentyears,withimportantnewsubjectscomingtotheforeparticularlyin vii viii PrefacetotheFourthEdition relation to the environment and maritime security. And these areas have been exceptionally“busy”.Thisfourthedition,undertheprincipaleditorshipanddirec- tionofProfessorProshantoMukherjee,togetherwithMarkBrownrigg,againtakes thebookintogreaterdetailonsomeofthese—aspectsoftechnicalpolicy,maritime security,liabilityandmore.Thiseditionalsodrawsmorecollectivelyonassociate authorshipcontributionsbyJingjingXuofUniversityofPlymouth,MaxMejiaof World Maritime University, Abhinayan Basu Bal of Lund University and by Donald Chard andDavid Balston fromtheUKChamberofShipping. Malmo¨,Sweden ProshantoK.Mukherjee London,UK MarkBrownrigg October2012 Foreword (Third Edition) Foreword It has often been said that shipping is the most international of all industries—as wellasbeingoneoftheoldest—anditisalsooneofthemostcomplicated.Eventhe most skilled navigator in the world probably has difficulty in finding his way through the maze of regulations adopted by IMO and other international organisations, and how many people can explain the way liner freight rates are developed and then go on to talk about the growth of containerisation and the importanceoftheconferencesystemandconcludebyanalysingtheissuesshipping facesto2000andbeyond?Thesimpleansweristhatthisbookcan. It represents one of the best introductions to the subject that is currently available. The first two editions established the book’s reputation and I am delighted to see that Bruce Farthing, Mark Brownrigg and the publishers have now produced a third. But it is far from being a reprint of the first two. The third editioncontainsmuchrevisedmaterialandseveralcompletelynewchaptersdeal- ingwithsuchsubjectsastheimportanceofshippingtoworldtradeandcontrover- sialmatterssuchasfreetradeversusprotectionism. Thebookhastheadvantagesofbeingcomprehensiveandconcise,authoritative andreadableallatthesametime.Itislikelytobeofbenefittothestudentwanting an introduction to the subject and the experienced observer wanting a handy summary.Icanthoroughlyrecommendittoboth.
