Kurtz, Ptofessor Emeritus of Accountancy. The tibute is included with these minutes. APPROVAL OF THE MINUTES The minutes of the meeting held on september l3rzol3 were approved as distributed. On behalf of the Committee on Professional Ethics and Academic Freedom (PEAF), Professor Chatles A. Gattis, Jr., Chair, inuoduced Resolution 13/2. He noted that the Faculty Senate approved a Policy on Conflicts of Interest 8 yeats ago in 2005. Recently the compliance office of the National Institutes of Health reviewed this Policy and forwarded several suggestions fot Policy modifications to Vice Ptesident for Research Leo Chalupa. The Administtation did not feel that these changes were very significant as they seemed to be clatifications to the cuttent Policy, for example, specifring iimelines where none were specified befote. The ptoposed changes were submitted for the PEAF Committee,s review, and the Committee agteed that thete was teally nothing substantive in the changes proposed. The Committee voted to support the proposed modificarions and Resolution Faculty Senate Minutes, October 11,2013 Page2 13/2 calls fot the Senate's approval of the amended (or redlined) version of the policy distributed with the meeting agenda. There being no discussion about the Resolution, a vote was taken, and Resolution \3/2was adopted unanimously. (Resolution 73/2is included with these minutes.) INTRODUCTION OF RESOLUTIONS No resolutions were introduced. OVERVIEW OF THE I.INIVERSITY'S INITIATIVES IN CHINA Provost Letman began by saying he thought that everyone at rhe meeting is prcbably awate that in the Univetsity's Strategic Plan there is a strong component of gtobalizition as' one of the key strategies fot the Univetsity. He added that he thought this is an oppo6une time to bring the Senate up to date on current initiatives in China, and make it aware of how the Administration is going to be consulting on further activities there. Of course, independent of the Strategic Plan, given China's scale and imporrance, the faculty and various groups within the faculty are doing all sorrs of things in thina, and have been doing so for many yeafs. Provost Lerman said he would address some of the highlights about some of these as well more recent activities underway, and then talk about the possibilities looking forward. In tetms of ongoing activity, GW has a number of educational research programs engaging with China ovet many years. The Sigur Centet [formetly called the Sigur d"rrt", fot Asian Studiesl in the Elliott School of Internationai Affaitr 6Sn; has an active program of scholarship and research where China is the object of study. GV also has exchange programs with a number of Chinese educational and research itganizations. In addition to ESIA, these activities involve Columbian College of Arts and Scliences (CCAS), the School of Business, the School of Public Health and Health Services, the School of Engineeting and Applied Science, the College of Professional Studies, and the Gelman Libtary. These are for the most pat smaller scale activities than those in the Sigur Centet. A second area of activity embodied in the Sttategic Plan is the growth in the numbers of intetnational students ftom China. This gtowth mirrots a nationai ttend. Fot GW, over the two year petiod ftom 2011 to 2073, that number has increased from75 3 to lrl77, Most of these are gtaduate students, but there ate also 267 undergtaduates who are now members of the GW student body. Recently the University opened a Confucius Institute on the Foggy Bottom Campus. There are more than 400 of these institutions wotldwilde, the first one in-this region having been established at the University of Maryland at College Park. All Confucius Institutes are sponsoted by Hanban which is an otganization created by China,s Ministry of Education. Gw's Confucius Institute partner in this activity is China's Naniing University. Largely dedved due to work undertaken by CCAS, the focus of GV's Institute centers on Chinese Faculty Senate Minutes, Octobet llr Z0ll Page 3 language and culture education. Unlike othet Institutes in the U.S. it focuses prcdominately on the teaching of adults rather than on teaching K-12 and college students. GWrs Institutl is also one of the larget ones in tefins of funding from the Chinese govefnmeflt. In addition, Ptesident Kttpp was asked to serve (and agreed to do so) on the Board of the headquarters of the Confucius Institutes to be established in Dupont Circle ro oversee the 90-plus U.S. btanches in the U.S. GW's School of Business also offers two Masterts progtams in which studeots spend the {irst part of their educatioa at Renmin Univercity's camp.r" at Suzhou, China. Renminrs main campus is in Beiiing; the Suzhou campus is one they also operate. These are cohort- based Programs, one being a Master's of Accountrng and the othir, a Mastet's of Finance. The students begin theit studies at Renmin, but admissions is handled entirely by GW and they ate GV students. While in Suzhou, these students take some speciaUzed coutses that focus particulady on Chinese accounting standards, which are somewhat distinct from U.S. and European based accounting. Following completion of their coutsework at Renmin, these students then come to Vashington to finish their ptograms, following the sarrre GW curriculum as other GW students, and receiving GW degreis at the end of their course of study. Ptovost terman next descdbed two otganizations eetablished by GV that are necessary fot it to conduct Executive Education programs in China. In otder to do this, thete has to be a legal entity that can actually have employees in China. Following the pattern that many Univetsities have adopted, including flaward, the Univetsi[, of Pennsylvania,,Yale, Duke, and many others, GW created in China a legal entity called a 'tvholly owned legal foreign enterprise" which is called a '3\WOFE,, in the vemacular. A U.S. Univetsity cannot employ people in China directly but a WOFE can. GWrs WOFE employs thtee people in total. In addition, this IWOFE is wholly owned and operated by another entity GW has created which is called Geotge \ffashington Woddwide LLC. This is a U.S. based nonpto{it, wholly opetated by GW, that ptovides some degtee of legal liability limitation by having GW's opetation in China held in turn by a subsidiary organization. Ptovost Lerman said thete is presently a two-person Boatd and he serves as Chair. This otganization has no employees, and none of the officers of either otganization receive any compensation beyond theit normal salaries from the University. The Provost said this arrangement is parallel in some ways to his serviee as Chair of the Mount Vernon College Boatd which still exists despite the fact that the College it is now part of G$/. Many of the University's activities in China have grown up entirely organically, but perhaps because of GV's visibility thete, it is being apptoached by other otginizations and universities about possible latger and more significant initiatives. Provost Lerman said that he had appointed an Advisoqz Committee of faculty who have expeftise in China. The grouP will help create and advise on the strategies that G\V will use going forward. At the firct meetingr Ptovost Lerman said he had laid out what he thought *1." a set of four important goveming ptinciples, i.e. what it would take fot GW to think of an idea as feasible or not. The oppottunities in ftont of G\V range ftom small to latge. Perhaps the single latgest and most signi{icant is that GI7 has been approached ,bort the possibititylf opening a campus in Beiiing. This would be basically creating a GW-China in parnership Faculty Senate Minures, October llr Z0l3 Page 4 with another Chinese rJnivetsity. It would also be a substanti al and significant change for GW' as it would be a definite departure ftom the student cohort model rih"r" groups go into an established GW program. The fitst of the fout ptinciples in considering future directions is that whatever the University creates needs to be consistent with its mlssion, which is teaching, research, and scholatship, and it needs to be aligned with the University,s overall ,rr",?gi" directions. Initiatives should be undertaken not because they can be done ot because GIW has been invited to do them. They must have some strategic value to the university before they are deemed a good thing to do. The second principle is academic quality, that is, the quality of the program should be consistent with what G\V would be wiuing to offer and opetate in Foggy Bottom. Whatevet is undertaken should meet the stanlards of quality that GtV faculty will be comfortable with. third governing principle is financial. Provost Lerman said that he and the President do not believe that the University ought to undertake anything that would requite a substantial investment of of create a sustained drain on Gw's resources. Other univetsities have putsued two different models in China. Some have made substantial investments in capital facilities thete. This does not appear to be in Gwrs intetest as it does not have as many tesources as othet players in China. China Programs need to be self- sustaining financially and not involve a capital investment. The foutth principle has to do with faculty buy-in. The University should not do anything unless thete is a strong sense among trre iaculty that it is in ihe Univetsityrs interest. People should al.s o be willing to vote with their feei, that is, some subset of faculty need to be willing to_ actively engage in_ the work of the proposed China-based operation. Ptovost Lerman said he 166trght these ptinciples should apply everyrvhere GW contemplates having a campus that is not physically in the united state.,-ro,,usi china. Ptovost Letman said that other Universities have tun afoul of these ptinciples to their dettiment and G\tr7 should not follow theit example. Right now the University has been approached about a China Presence, but there ir nL commi"tment to something like this. He added that he thought it has been made very clear that the four principles iuit outlined are the statting point for even consideting becoming actively engaged. Beyond that, there may be details where an initiative does not work for tle university or for the partner. oppottunities that don't align with the four principles are probably initiatives the university should not even invest significant time in p.rr...i.g, b"cuur. that takes enefgy and time away from other things the University ought i" U. *oiting on. The Provost acknowledged there have been a lot of rumors making the rounds about a China presence. The University is nowhete down the toad on anythin! rt" that, and the four principles set a rrretry high bar to undefiaking something like it i.. ft isnrt self-evi<lent that that any offer GV is likely to get would meet its criieria. Through the Advisory Committee the University will be consulting about initiatives; any such activities that meet Faculty Senate Minutes, Octobet 11rZA13 Page 5 the fout ctiteda would have to come back to convetsation at anothet Faculty Senate meeting. Having covered initiatives already underway in China and desctibing how the Univetsity will evaluate the prospect of establishing a GW campus in China, the Provost said he thought thete are additional oppottunities, for example, cofltinuing to look at whether or not GW can be a place for cefiain types of Executive Education oppornrnities for Chinese executives. Many of these executives want to have an experience in Washington D.C. as part of such a program. The University has a strong locational advantage for ihis, and GtrV has certain ateas whete it has great strength in many of the ateas Chinese executives want to pursue, including doing business in the U.S. Provost Letman next covered the process that would need to unfold if opporunities in China ptesent themselves that meet the four criteria he outlirred. A detailed planning phase would have to occur in which the Univercity would look at the financial dsks and tewatds of a ptoiect as well as whete the progtam would be physically tocated. Questions would have to be answered about where the land would come from. Govemance questions would have to be addtessed, such as how such an undertaking might best be administered in the regulatory envitonment existing in China. There ate also questions about how faculty will be appointed to an institution that is not physically in the U.S. There are also questions about the degtee of academic freedom, as well as tuition levels and financial aid in China, and how the Univetsity could be competitive. AII of these things need to be weighed and consideted before a yes or no decision is made. Ptovost Letman concluded his rematks by observing that China is an amazingly interesting place. It is a country of about 1.4 billion people with the second largest economy in the wotld, one that is still gtowing quite rapidly, although not as quickly as previously. It is also a place people need to understand, particulatly students, who need to be prepared for a wotld in which China is a significant player. At the same time the University needs to be very conscious that thete ate probably important ways to engage that ate to its benefit and thete ate probably options that are not. China is a very complicated place and it is also a place of great change. Thete ate explicit and implicit des to be learned and followed, and of course, the system of govetnance there is quite different than that of the U.S. China does want erigagement internationally but only of particular type6. The Univercity must be careful in how to proceed, as there is a danger being way too cautious and there is a danget of being imptudent. Thete is a line that needs to be walked quite thoughtfully while seeking the advice of people hete in the community and outside who are knowledgeable about China, ensuting that the University faculty feels like new initiatives are actually in GW's interest. Discussion followed. Professor Castleberry exptessed appteciation fot the briefing and asked about the tole of the Advisory Committee with respect to the way in which faculty have input into the development of new programs that reflect their sphetes of interest. Ptovost Letman responded that the answer was twofold. The Advisory Committee will need to identi$, possible oppoftunitiesl howeve\ at the level of designing programs, the Committee may or may not have people on it who have that expertise. It would then be Faculty Senate Minutes, Octobet llr 20ls Page 6 necessary to go to the faculry at the University who actually teach in that atea and seek their advice about what a good program should look like. President Korpp said he thought it probably worth pointing out that GW has a numbet of progtams offeted by its faculty in many countries ,.ornd the wotld. As an example, GW has had an active program in Emergency Medicine in East Aftica for quite a long time, and it has been quite a successful program. Many of the other schools have these, and they are driven by the deans of the individual schools. He added that he thought the thteshold question concems how the University goes beyond that to the idea of actuilly establishing its own physical presence elsewhere, rather than wotking in partnership o, ,, * client of someone else. That is a whole different marter, and it is this quistion thai has led to the need for a higher level Committee that is outside the individual schools who handle existing programs. Ptofessot Gartis said he had iust rcad a very interesting article in the New yotk Times about the New Yotk University progmm in China, and saii he thought it highlights a aumber of very interesting issues. One is that in China there is a huge pop,rta--tiori*ittt ttemendous intetest in westem ways of doing business and study in business programs. New York Univetsity has set up a degree granting program in China, but in order to do that it had to go to three ministries in China and get approval from all of them. The approval ftom the thitd ministry did not come about fot three years New York Univetsity also had guiding principles that wete interesting and one was that they wouiti not chatge lower tuition for China programs than in New York. I{yIl fotesaw thousands of students patticipating in this so thi; was truly a tremendous revenue generator they wete looking at, but business is somewhat different than other programs. Fot example, Yale set up a vefy intetesting collaboration with Peking University thit was supposed to have been a tremendous scholarly activity but it died largely because it did not atttact much entollment. GW's own School of Engineering under Dean Tong ttied to set up a program in Beiiing but the engineeting and science programs in China are so good that people; particulatly the best students, dontt want to study engineeting and science over in China. So there seems to be something very unique about business because thatts what they teally want; in terms of genetating fevenue, that's where the area is. But the hard part seems to be getting permission to give degrees ovet there. Provost Letman said that only two American universities now have degtee-gtanting status in China: NYU and Duke. A couple of other foteign institutions atso ha,r. been granted this permission, but the number of such permissions is very limited. Both Duke and NYU have built out camPuses in China, so they have made enofmous investments thete. In some cases they have received substantial subsidies from the government to do so. Realistically, obtaining degree granting status isn't likely to be linked io the willingness to build out a camPus in China and cettainly, if GW does want to make that commiiment it would haYe to be very carefully thought out. The Chinese government has signaled that there will be more such licenses, but the total number that will be availablewill not be large. Faculty Senate Minutes, October llr Z0l3 PageT Given that China and globalization are such an important part of the Strategic plan, Professor Brazinslry inquited if GW has a plan to create 1t. o*r, pool funds for individual faculty who are interested in developing their own programs and have their own contacts in China. Ptovost Lerman said that most of GV's programs there have originated organically Tuch in that way but as of now there are no plans to establish a special iivestment fund for China. Because the Chinese regulatory environment is so complicated, it is probably a good idea fot individual faculty who ate contemplating such proposals to con-sult with GW,s Office of Genetal Counsel in otder to be sure that such initiatives will be permissible. Professor Pdce said she had had some expedence in China and with study abroad programsr and noted that the tendency is to opefate these programs as enclaves. Either American students interact only with each otheior programs are created in China that serve only Chinese students. She inquired if one of the pdnciples for establishing progtams in China might include a more integrated approach where thl goal would be for"American and Chinese students to intetact and to leam collaboratively, F.ovo.t Lerman said he would ptefet an integtative model and pointed out that in the Sttategic Plan, there is tecognition that intemational experiences for students should have depih to them and fostel deep cultutal engagement- Ptesident Knapp noted that there are models for this kind of program. For example, one Johns Hopkins program involves a fifty-fifty match between Chinese and American students who study and room together. Columbian College is also looking at the possibility of offeting multicontinental experiences fot students wh1re, for examplJ, they might move as a cohort from Asia to Europe. That is another model that aims ,i gi"irrg , richet kind of expetience than the enclave model and would involved mixtures of students from various continents in each of these prograrls. GENERAL BUSINESS I. Ptofessot Rehman moved the nominations of Beverly Westerman as Acting Chait of the Athletics and Recreation Committee, and Moses Schanfield as a member of the Committee on Appointment, Salaryr and Promotion Policies. Both faculty members were elected. Professot Rehman also advised that the Executive Committee had been notified that Professot Joseph Cotdes is on medical leave for rest of the fall semestet. After wishing him well, Professor Rehman nominated Ptofessor Edward Cherian as Interim Chair of the Fiscal Planning and Budgeting Committee for the balance of the fall semest e4 2013. professor Patsons was nominated ftom the floor and the nomination was seconded. A vote was taken, and Professor Cherian was elected. II. ANNUAL REPORTS OF SENATE STANDING COMMITTEES The2072'73 Annual Repot of the Ffonots & Academic Convocations Committee was distributed with the meeting agenda. No other Annual Reports were submitted. REPORT OF THE EXECUTIVE COMMITTEE Professor Rehman presented the report, which is included with these minutes, President Krrrpp asked if there were comments or questions about the repott. Professot Parsons said he was sedously troubled about revisions of the Facuhy Code by the Board of Trustees. President Knapp said that thete would be fucher discussion of the issue that Professor Parsons was mising, and suggested in the interest of ordedy discussion that these comments be defetred to Brief Statements or Questions. Professor Parsons obiected, saylng that questions had been invited about items in the Executive Committee Report. Discussion between Professor Parsons and the President followed, after which Professot Patsons asked about Ptofessot Rehman's statements that fevision of the Faculty Code was to be done within a shated govefnance framework. He asked if anyone had received teassurance that any Code changes would be approved by the Senate in the notmal ways. Professot Rehman responded that the Executive Committee is still working with the Board and that she believed the PEAF Committee had recently met and would present a statement about this later in the meeting. IV. PROVOST'S REMARKS Provost Lerman reported that the process had begun for authorizing a Dean seatch in two of the schools. The GWLS has now elected a seatch committee and the Provost said he had met with the leaders of the group that morning. The hope and expectation is that the search will be completed by the end of this academic year. The School of Business has also begun a search. Ptofessor Rehman advised that a search committee had been elected by the School that monring. The Provost also commented about another successful Teaching Day. Thete were two outstanding speakers at this yea/s event who came in to addtess participants. Provost Letman also said he had met with all of the department chaits in a lunch meeting to talk about how the Univetsity values teaching, and also about tenure and promotion cases, i.e. encouraging the chairs to find many different ways to understand and document teaching effectiveness for promotion and tenure cases in their respective departments. He added that his sense was that the Chairs welcomed the opportunity to be able to use different types of evidence about teaching conttibutions and bting to beat on things like peer reviews, including external teviews as well as traditional student evaluations in trying to assess the effectiveness of a faculty memberts teaching The Ptovost also mentioned a confetence he had just attended where he was part of a panel discussing the issuance of a memorandum last February by the Office of Science and Technology Policy (OSTP) telling every Fedetal agency that has research of over g100 milliorr a year that it needs to put in place tequitements and processes so that the datasets that ate cteated in that reseatch afe preserved and documented. Some researchers at the Univetsity alteady may do that fot some of the agencies that already have such requirements. What is new is that those regulations ate going to be universal. Foftunately Faculty Senate Minutes, October l1^r ZOl3 Page 9 or unfottunately, each agency gets to decide how to implement the OSTp memorandum in the way it sees fit. This is essentially a mandate from the rVhite Flouse -- it has no funding attached to it for the agencies, and so it's unlikely the agencies will then pass on funding tI universities and other otganizations that must meet these requifements. Vork is underrvay to figute out how the University will comply once these regulations come down the road. University Librarian Geneva Henry, has been very involved in the community that is trytng to determine whar all this will ttanslate into. ThL OSTP memotandum leaves a lot of room for interprctation, for example, it allows for the possibility that otganizations might make iudgments about the telativi value of presering data as compated to its administrative costs. At present there is no clue how such iudgments should be made and there is virtually no guidance today about how to do that. There is also a statement in the memorandum along the lines thai documenters of those datasets, be they universities or federal agencies themselves, have to provide ADA- compliant access to them. It will be necessary to ptovide metadata and all of this will eventually fall on the principal investigatots of reseatch graflts at the University. Some of these PI's have Iittle experience in datapreservation. ConsequentlY, -the Univetsiry is looking at where it has the aurhority and tesponsibility to help faculty comply with these tequirements and what services need to be ptovided fot the faculty so that they can stay in compliance. It is q-ui"it e likely that agencies may be teiecting gant applications if the coffect information ,rot suppli.a.- At a minimum, some agencies ate alteady using data pteseration plans as one of tU. criteria they ate scorirrg grant applications on, so the University needs to help faculty write these sections and also put into place teal infrasffucture that will help wiih data preservation effots. There ate also tequirements for long-term storage withouispecifring how tong this would be. Ptovost Lerman said he thought most of the people in tlis fiLld-are saying iust think forevet, and t!,at's ptobably a good approximation to long term. But he noted *fyly that fotever is a really long time. And no one fully undetstands the costs, particulady ior those tesearch ptoiects that are generating extremely large datasets. If-one thinks of Ptoteomics and genomics work, and computational biology, these ate fields that are doing large scale DNA sequencing of many, many samples. The datasets can become enormous. Thete is also another whole dimension, which is that some datasets need to be redacted because the information in them needs to be held confidentially either because it reveals medical data that could be traced to a single individual or it is proprietary data that some company owns that someone may have licensed for their teseatch, and therefore it can,t be posted. All these things are anticipated in the guidelines, but tanslating the guidelines into regulations is going to be a real challenge. Provost Lerman said his g,rIr. would be the Office of the Vice President for Research and the Univetsity Libratii-n will be actively involved in how this all plays out. But it is going to be yet ut oih., set of requirements th;t faculty reseatchers who genetate datasets will have to deal with going forwati. The provost concluded by saying he would keep the faulty apprised as this continues to unfold. Discussion followed. Ptofessor Yezer commented that this might ultimately be useful because when datasets ate posted to a website, people lind the d-ata conrrenient to access and will then reference it, which is a plus. The Ptovost said this was pointed out at Faculty Senate Minutes, Octobet 71,2013 Page 10 the conference. It might even be possible to start measuting hits against datasets as a measure of the impottance of those datasets to the disciplines and one can imagine those being among the metrics used to measure the importance and the televance of reseatch activities around the country. A question was posed about the time ftame for developing these procedures. Provost Lerman noted that, with the federal government shutdown, it was Iikely that literally no wotk was presently getting done on this. He added that aspirationally, he thought thai the White Flouse wanted this done really quickly, but it would probably take much longer for people to Put this in place. The Association of Research Libraries (ARL) has activef been working through its vatious gtoups to interact with the fedetal agencies to help make sute that the agencies think through all the practical aspects of this. In all profatitity, some agencies will do it soonet and some will do it later but it is going to rake a while. V. CHAIR'S REMARKS President Ko.Pp said he had been asked by a number of people about the impact of the govemment shutdown on the University and the possibility of a govemment failure to raise the debt ceiling. He then read the following overyiew to the Senate: o Vhile we have seen some disruptions to research, the maiority of grants remain unaffected. Student financial aid is also largely unaffected ar this point. Flowever, veterans may not receive benefits in a prolonged shutdown. o We have contacted all schools to leatn the impact of the shutdown on theit operations. Of the five schools (School of Medicine and Health Sciences (SMHS), GW Law School, Elliott School of Intetnational Affairs (Elliott), School of Public Health and Health Serwices (SPHHS), and School of Nursing) that responded to the inquiry, only School of Nursing reported no immediate effects. o The situation is fluid. New problems continue to arise and issues are likely to gtow each d.y. o A failure to increase the debt ceiling would create more issues, such as the possibility of delayed Medicare and student-aid payments. Students ' student financial aid for the fall semester has not been disrupted. r For October, tuition assistance benefits for vetetans and military sewice membets were paid normally. o The Intetnational Services Office stated that student travel and visa and passport issuances have not been disrupted.
