Boiler pipes are used in Boilers, Heat Exchangers. Super Heaters find Condensers, and in mechanical, structural and general engineering industry. Railways etc 5, Seamless Pipes and Tubes are classified under Customs sub-neading No, 73.04 of Chapter 73 of the Customs Farifl Act, 1975. The classifcation is however, indicative oniy and in no way binding en the scone af the present investigations. Domestic Industry and Standing 6 The application has heen fied by M/s. [SMT Limited, Pune and supported by Mis. Maharastra Seamless Limited and Mis, Jindal Saw Limited. Mis Bharat Heavy Elecincal Limited (BHEL) and M/s Re Meta's Ltd. are the other known producers of the product under consideration in lndia It & nated that Ws Bharat Heavy Electrica! Limited (BHEL) and M/s Jindal Saw Limited have imported the product under consideration fram the subject country in the period of imestigation. BHEL nas substantialy consumed the product captively and fas even purchased the same from ciner Indian Producers. The Authority has considees BHEL as ineligible domestic industry, However, the volume of imports made byMis Jindat Saw Lirited are however quite low and in view of that the Authonity has considered M's Jindat Saw as elgile domestic industry. It is noted that (a) production of the applicant constitutes @ major propottion in Indian production; (&} domestic producers expressly supporting the Application account for more thar 80 percent of production af the like product produced by the domestic mdustry: and (0} the application has been made by or on betall of the domestic industiy. The Authorty ater examining the informatioy on record determines that the applicant (with or without exclusion of M/s Jindal Saw Liited constitutes domestic Industry within the meaning of the Rule 2 aad the application satisfies the teria of standing in terms of Rule 5 of the Rules supra Country Invalved 7. Inports of te product under consideration are significantly undercutting the domestic prices and the effect of such imports was to prevent prog increases which otherwise would have occurred to a sighiticant degree. On the basis of the information proviced with regard to various ecancric parameters relating la the domestic industry, it is sean that the performance of the domestic industry materialy deteriorated. inter-alia, and collectively & cumulatively in terms of production, capactty utilization, domestic sales values & volume. piofits, rewen on investments, cash flow. inventories and market share.
