F.E.R.A. 169/95-RB Permission for subscribing to the Memorandum and Articles of Association of an Indian Company G.S.R. 7(E).—In pursuance of clause (b) of sub-section (1) of Section 29 read with clause (d) of sub-section (1) of 20 GI/96 2 __ _^__ THE GAZETTE OF_[ND1A : EXTRAORDINARY _^ _ [PART II—SE,C.3JJ)X Section 19 of the Foreign Exchange Regulation Act, 1973 (46 of 1973), the Reserve Bank is pleased to amend its Notification No. F.E.R.A. 143/93-RB dated 26th April, 1993 with immediate effect as under ;— In the said Notification, the condiiion (ii) shall be substituted by the following, namely :— "(ii) such company is not engaged in any activity relating 10 agriculture or plantation." F.E.R.A, 170/95-RB Sale/Transfer of shares/bonds/d Ventures by OCBs with repatriation rights through Stock Exchange G.S.R. 8(E).—In exercise of the powers conferred by sub-section (6) of section 19 of the Foreign Exchange Regula- tion Act, 1973 (46 of 1973), the Reserve Bank, being of the opinion that it is necessary and expedient in the public interest so to do, with immediate effect amends its Notification No. F.E.R.A, 150/93-RB dated 26th April, 1993 as under : "In the said Notification— (i) in the opening paragraph, after I he words" made by a person, who is a citizen of India or a person of Indian origin and resident outside India" the following words shall be inserted, namely :— "or an overseas Corporate Body," (ii) after the Explanation II, a new Explanation shall be inserted as follows, namely :— 3 "(iii) The expression 'Overseas Corporate Bt J>' .ne.ins any overseas company, partnership firm, society and cither corporate body predominantly owned directly or indi.crtlv to the extent of atleast 60 per cent by NRJs and includes any overseas trust in which not less than 60 per cent beneficial Lnorest is held by NRfs directly or indirectly, but, irrevocably."
