Mobex is MCLM’s predecessor-in-interest. Mobex is also MCLM’s affiliate. Since Mobex is MCLM’s predecessor-in-interest, then MCLM should also have included Mobex’s affiliates. Mobex, and now MCLM, operates AMTS site-based licenses along the Pacific and Atlantic Coasts, the Great Lakes, the Gulf Coast and the Mississippi River Waterway. [Exhibit 4.1]: Mobex Network Services, LLC—MCLM’s Affiliate and Predecessor-in- Interest MCLM states in the below that it acquired Mobex Network Service LLC (“Mobex”). The Commission’s Records also witness that MCLM acquired the spectrum assets of Mobex. Per the below, MCLM has the same management team as Mobex and has taken over the operations of Mobex (MCLM didn’t just acquire Mobex’s licenses, but also its business and any income stream). Mobex is MCLM’s predecessor-in-interest. For these reasons, Mobex is an affiliate of MCLM and therefore Mobex’s gross revenues should have been attributed to MCLM. In 2004, Mobex applied to participate in Auction No. 57 with no bidding credits. Thus, it would appear that Mobex had sufficient gross revenues to not qualify for even a 25% bidding discount.
