LICENSE AGREEMENT FOR IPOD TOUCH SOFTWARE PLEASE READ THIS LICENSE AGREEMENT ("LICENSE") CAREFULLY BEFORE DOWNLOADING OR USING THE APPLE IPOD TOUCH SOFTWARE. BY DOWNLOADING OR USING THE APPLE IPOD TOUCH SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT DOWNLOAD OR USE THE SOFTWARE. 1. General. The software, interfaces, content, fonts, documentation and any data accompanying this License, whether on disk, in read only memory, on any other media or in any other form (collectively the "iPod touch Software") are licensed, not sold, to you by Apple Inc. ("Apple") for use only under the terms of this License, and Apple reserves all rights not expressly granted to you. The rights granted herein are limited to Apple's intellectual property rights in the iPod touch Software and do not include any other patents or intellectual property rights. You own the media on which the iPod touch Software is recorded but Apple and/or Apple's licensor(s) retain ownership of the iPod touch Software itself. 2. Permitted License Uses and Restrictions. (a) This License allows you to download, install and use the iPod touch Software on any Apple-branded iPod touch you own or control. This License does not allow you to install the iPod touch Software on iPod touch devices that you do not own or control, and you may not distribute or make the iPod touch Software available over a network where it could be used by multiple devices at the same time. You may make one copy of the iPod touch Software in machine-readable form for backup purposes only, provided that the backup copy must include all copyright or other proprietary notices contained on the original. You may not rent, lease, lend, sell, redistribute or sublicense the iPod touch Software. This License does not grant you any rights to use Apple proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of third party devices and accessories, or third party software applications, for use with the iPod touch. Some of those rights are available under separate licenses from Apple. For more information on developing third party devices and accessories for the iPod touch, please email [email protected]. For more information on developing software applications for the iPod touch, please email [email protected]. (b) You may not and you agree not to, or to enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the iPod touch Software or any services provided by the iPod touch Software, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by licensing terms governing use of open-sourced components included with the iPod touch Software). Any attempt to do so is a violation of the rights of Apple and its licensors of the iPod touch Software. If you breach this restriction, you may be subject to prosecution and damages. (c) By storing content on your iPod touch you are making a digital copy. In some jurisdictions, it is unlawful to make digital copies without prior permission from the rightsholder. The iPod touch Software may be used to reproduce materials so long as such use is limited to reproduction of non- copyrighted materials, materials in which you own the copyright, or materials you are authorized or legally permitted to reproduce. 3. Consent to Use of Non-Personal Data. (a) You agree that Apple and its subsidiaries may collect and use technical and related information, including but not limited to information about your iPod touch, computer, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the iPod touch Software, and to verify compliance with the terms of this License. Apple may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you. (b) Apple may provide certain services through your iPod touch that rely upon location information. To provide these services, Apple and its partners may transmit, collect, maintain, process and use your location data, including the real-time geographic location of your iPod touch. By using any location-based services on your iPod touch, you agree and consent to Apple's and its partners' transmission, collection, maintenance, processing and use of your location data to provide you with such services. The location data is collected in a form that does not personally identify you. You may withdraw this consent at any time by not using the location-based features. Not using these features will not impact the functionality of your iPod touch. 4. iTunes Store and other Services; Third Party Materials. The iPod touch Software enables access to Apple's iTunes Store and other Apple and third party services and web sites (collectively and individually, "Services"). Use of the Services requires Internet access and use of certain Services requires you to accept additional terms of service. By using this software in connection with an iTunes Store account, you agree to the latest iTunes Store Terms of Service, which you may access and review at http://www.apple.com/legal/itunes/ww/. You understand that by using any of the Services, you may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, you agree to use the Services at your sole risk and that Apple shall have no liability to you for content that may be found to be offensive, indecent, or objectionable. Certain Services may display, include or make available content, data, information, applications or materials from third parties (“Third Party Materials”) or provide links to certain third party web sites. By using the Services, you acknowledge and agree that Apple is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third Party Materials or web sites. Apple, its officers, affiliates and subsidiaries do not warrant or endorse and do not assume and will not have any liability or responsibility to you or any other person for any third-party Services, Third Party Materials or web sites, or for any other materials, products, or services of third parties. Third Party Materials and links to other web sites are provided solely as a convenience to you. Financial information displayed by any Services is for general informational purposes only and is not intended to be relied upon as investment advice. Before executing any securities transaction based upon information obtained through the Services, you should consult with a financial professional. Location data provided by any Services is for basic navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage. Neither Apple nor any of its content providers guarantees the availability, accuracy, completeness, reliability, or timeliness of stock information or location data displayed by any Services. You agree that the Services contain proprietary content, information and material that is owned by Apple and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the Services. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and you shall not exploit the Services in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity. You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that Apple is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that you may receive as a result of using any of the Services. In addition, third party Services and Third Party Materials that may be accessed from, displayed on or linked to from the iPod touch are not available in all languages or in all countries. Apple makes no representation that such Services and Materials are appropriate or available for use in any particular location. To the extent you choose to access such Services or Materials, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. Apple and its licensors reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will Apple be liable for the removal of or disabling of access to any such Services. Apple may also impose limits on the use of or access to certain Services, in any case and without notice or liability. 5. Termination. This License is effective until terminated. Your rights under this License will terminate automatically without notice from Apple if you fail to comply with any term(s) of this License. Upon the termination of this License, you shall cease all use of the iPod touch Software. 6. Disclaimer of Warranties. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE IPOD TOUCH SOFTWARE AND SERVICES IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE IPOD TOUCH SOFTWARE AND ANY SERVICES PERFORMED BY THE IPOD TOUCH SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND APPLE AND APPLE'S LICENSORS (COLLECTIVELY REFERRED TO AS "APPLE" FOR THE PURPOSES OF SECTIONS 6 AND 7) HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE IPOD TOUCH SOFTWARE AND SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. APPLE DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE IPOD TOUCH SOFTWARE AND SERVICES, THAT THE FUNCTIONS CONTAINED IN OR SERVICES PERFORMED BY THE IPOD TOUCH SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE IPOD TOUCH SOFTWARE AND SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS IN THE IPOD TOUCH SOFTWARE AND SERVICES WILL BE CORRECTED, OR THAT THE IPOD TOUCH SOFTWARE WILL BE COMPATIBLE OR WORK WITH ANY THIRD PARTY SOFTWARE, APPLICATIONS OR THIRD PARTY SERVICES. INSTALLATION OF THIS SOFTWARE MAY AFFECT THE USABILITY OF THIRD PARTY SOFTWARE. YOU FURTHER ACKNOWLEGE THAT THE IPOD TOUCH SOFTWARE AND SERVICES ARE NOT INTENDED OR SUITABLE FOR USE IN SITUATIONS OR ENVIRONMENTS WHERE THE FAILURE OF, OR ERRORS OR INACCURACIES IN THE CONTENT, DATA OR INFORMATION PROVIDED BY, THE IPOD TOUCH SOFTWARE OR SERVICES COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE, INCLUDING WITHOUT LIMITATION THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, LIFE SUPPORT OR WEAPONS SYSTEMS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY APPLE OR AN APPLE AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE IPOD TOUCH SOFTWARE OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU. 7. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL APPLE BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA, FAILURE TO TRANSMIT OR RECEIVE ANY DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE IPOD TOUCH SOFTWARE AND SERVICES, OR ANY THIRD PARTY SOFTWARE OR APPLICATIONS IN CONJUNCTION WITH THE IPOD TOUCH SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF APPLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Apple's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose. 8. Digital Certificates. The iPod touch Software contains functionality that allows it to accept digital certificates either issued from Apple or from third parties. YOU ARE SOLELY RESPONSIBLE FOR DECIDING WHETHER OR NOT TO RELY ON A CERTIFICATE WHETHER ISSUED BY APPLE OR A THIRD PARTY. YOUR USE OF DIGITAL CERTIFICATES IS AT YOUR SOLE RISK. APPLE MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, AS TO MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, ACCURACY, SECURITY, OR NON- INFRINGEMENT OF THIRD PARTY RIGHTS WITH RESPECT TO DIGITAL CERTIFICATES. You agree that (a) you will not falsify or misuse any certificate; (b) you will use Digital Certificates for legal purposes only and in accordance with any applicable Certificate Policy, Certificate Practice Statement or other Certificate Authority business practice disclosures; (c) you are solely responsible for preventing any unauthorized user from making use of your Digital Certificates; and (d) you will revoke any certificate that you have reason to believe has been compromised. 9. Export Control. You may not use or otherwise export or reexport the iPod touch Software except as authorized by United States law and the laws of the jurisdiction(s) in which the iPod touch Software was obtained. In particular, but without limitation, the iPod touch Software may not be exported or re-exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List or Entity List. By using the iPod touch Software, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use the iPod touch Software for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture or production of missiles, nuclear, chemical or biological weapons. 10. Government End Users. The iPod touch Software and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States. 11. Controlling Law and Severability. This License will be governed by and construed in accordance with the laws of the State of California, as applied to agreements entered into and to be performed entirely within California between California residents. This License shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect. 12. Complete Agreement; Governing Language. This License constitutes the entire agreement between the parties with respect to the use of the iPod touch Software licensed hereunder and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by Apple. Any translation of this License is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License shall govern. 13. Third Party Acknowledgements. Portions of the iPod touch Software may utilize or include third party software and other copyrighted material. Acknowledgements, licensing terms and disclaimers for such material are contained in the electronic documentation for the iPod touch Software, and your use of such material is governed by their respective terms. 14. Use of MPEG-4. The iPod touch Software is licensed under the MPEG-4 Systems Patent Portfolio License for encoding in compliance with the MPEG-4 Systems Standard, except that an additional license and payment of royalties are necessary for encoding in connection with (i) data stored or replicated in physical media which is paid for on a title by title basis and/or (ii) data which is paid for on a title by title basis and is transmitted to an end user for permanent storage and/or use. Such additional license may be obtained from MPEG LA, LLC. See http://www.mpegla.com for additional details. The iPod touch Software contains MPEG-4 video encoding and/or decoding functionality. The iPod touch Software is licensed under the MPEG-4 Visual Patent Portfolio License for the personal and non-commercial use of a consumer for (i) encoding video in compliance with the MPEG-4 Visual Standard (“MPEG-4 Video”) and/or (ii) decoding MPEG-4 video that was encoded by a consumer engaged in a personal and non-commercial activity and/or was obtained from a video provider licensed by MPEG LA to provide MPEG-4 video. No license is granted or shall be implied for any other use. Additional information including that relating to promotional, internal and commercial uses and licensing may be obtained from MPEG LA, LLC. See http: //www.mpegla.com. H.264/AVC Notice. The iPod touch Software contains AVC encoding and/or decoding functionality, commercial use of H.264/AVC requires additional licensing and the following provision applies: THE AVC FUNCTIONALITY IN THE IPOD TOUCH SOFTWARE IS LICENSED HEREIN ONLY FOR THE PERSONAL AND NON-COMMERCIAL USE OF A CONSUMER TO (i) ENCODE VIDEO IN COMPLIANCE WITH THE AVC STANDARD ("AVC VIDEO") AND/OR (ii) DECODE AVC VIDEO THAT WAS ENCODED BY A CONSUMER ENGAGED IN A PERSONAL AND NON-COMMERCIAL ACTIVITY AND/OR AVC VIDEO THAT WAS OBTAINED FROM A VIDEO PROVIDER LICENSED TO PROVIDE AVC VIDEO. INFORMATION REGARDING OTHER USES AND LICENSES MAY BE OBTAINED FROM MPEG LA L.L.C. SEE HTTP://WWW.MPEGLA.COM. 16. Yahoo Search Service Restrictions. The Yahoo Search Service available through Safari is licensed for use only in the following countries: Argentina, Aruba, Australia, Austria, Barbados, Belgium, Bermuda, Brazil, Bulgaria, Canada, Cayman Islands, Chile, Colombia, Cyprus, Czech Republic, Denmark, Dominican Republic, Ecuador, El Salvador, Finland, France, Germany, Greece, Grenada, Guatemala, Hong Kong, Hungary, Iceland, India, Indonesia, Ireland, Italy, Jamaica, Latvia, Lithuania, Luxembourg, Malaysia, Malta, Mexico, Netherlands, New Zealand, Nicaragua, Norway, Panama, Peru, Philippines, Poland, Portugal, Puerto Rico, Romania, Singapore, Slovakia, Slovenia, South Korea, Spain, St. Lucia, St. Vincent, Sweden, Switzerland, Taiwan, Thailand, The Bahamas, Trinidad and Tobago, Turkey, UK, Uruguay, US and Venezuela. Network Charges Google does not charge for downloading or using Google Maps for mobile, but depending on your plan and your carrier or provider, your carrier or other provider may charge you for downloading Google Maps for mobile or for use of your mobile phone when you access information or other Google services through Google Maps for mobile. Non-Commercial Use Only Google Maps for mobile is made available to you for your non-commercial use only. This means that you may use it for your personal use only: you may use it at work or at home, to search for anything you want, subject to the terms set out in these Terms and Conditions. You need to obtain Google's permission first, which you can do by contacting [email protected], if you want to sell Google Maps for mobile or any information, services, or software associated with or derived from it, or if you want to modify, copy, license, or create derivative works from Google Maps for mobile. Unless you have our prior written consent, you agree not to modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from Google Maps for mobile. Furthermore, you may not use Google Maps for mobile in any manner that could damage, disable, overburden, or impair Google's services (e.g., you may not use the Google Maps for mobile in an automated manner), nor may you use Google Maps for mobile in any manner that could interfere with any other party's use and enjoyment of Google's services. Intellectual Property As between you and Google, you agree and acknowledge that Google owns all rights, title and interest in and to Google Maps for mobile, including without limitation all associated Intellectual Property Rights. "Intellectual Property Rights" means any and all rights existing from time to time under patent law, copyright law, trade secret law, trademark law, unfair competition law, and any and all other proprietary rights, and any and all applications, renewals, extensions and restorations thereof, now or hereafter in force and effect worldwide. You agree to not remove, obscure, or alter Google's or any third party's copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the Google Maps for mobile. Disclaimer of Warranties Google and any third party who makes its software available in conjunction with or through Google Maps for mobile disclaim any responsibility for any harm resulting from your use of Google Maps for mobile and/or any third party software accessed in conjunction with or through Google Maps for mobile. (b) Vous ne pouvez pas ou vous acceptez de ne pas, que ce soit pour votre compte ou le compte d'autrui, copier (sauf et exclusivement dans les limites permises par la présente Licence), décompiler, procéder à l'ingénierie inverse, désassembler, tenter de dériver le code source du, déchiffrer, modifier ou créer des produits dérivés du, Logiciel de l'iPod touch ou tout autre service proposé par le Logiciel de l'iPod touch, ou de toute partie de ceux-ci (dans toute la mesure permise par les restrictions précédemment mentionnées applicables par disposition légale ou dans toute la mesure permise par la présente Licence régissant l'utilisation de composants Open source inclus dans le Logiciel de l'iPod touch). Toute tentative de ce genre constitue une violation des droits d'Apple et de ses concédants de licence pour le Logiciel de l'iPod touch. Tout manquement à ces restrictions serait par conséquent susceptible de poursuites et de dommages et intérêts. (c) Le stockage d'informations sur votre iPod touch revient à créer une copie numérique. Pour certaines juridictions, la reproduction numérique sans autorisation préalable du titulaire des droits de reproduction est illégale. Le Logiciel de l'iPod touch peut être utilisé pour la reproduction de contenu pour autant que cette utilisation se limite à la reproduction de contenu non protégé par des droits d'auteur dont vous avez la propriété, pouvant être reproduit ou pour la reproduction duquel vous disposez d'une autorisation légale. 3. Accord relatif à l'utilisation des données non personnelles. (a) Vous acceptez qu'Apple ainsi que ses filiales puissent rassembler et utiliser des informations techniques et afférentes, incluant, sans s'y limiter, des informations concernant votre iPod touch, votre ordinateur, vos logiciels système et applications, et les périphériques ; ces informations sont recueillies régulièrement pour faciliter la mise à disposition de mises à jour de logiciels, d'assistance produits et de services divers proposés au client (le cas échéant) relatifs aux logiciels iPod touch et pour vérifier la conformité aux conditions générales de cette Licence. Apple peut utiliser ces informations, en veillant à ce que l'identité du client ne soit pas dévoilée, afin d'améliorer ses produits ou de proposer des services et des technologies au client. (b) Apple peut vous fournir certains services basés sur des informations géographiques via l’iPod touch. Pour fournir ces services, Apple et ses partenaires peuvent recueillir, conserver, traiter et utiliser les données concernant votre localisation, notamment la position géographique en temps réel de votre iPod touch. En utilisant sur votre iPod touch un des quelconques services gérant la localisation, vous acceptez qu’Apple et ses partenaires transmettent, recueillent, conservent, traitent et utilisent les données concernant votre localisation pour vous fournir lesdits services. Le recueil de ces données de localisation ne vous identifie pas personnellement. Vous pouvez retirer votre accord à tout moment en ne vous servant pas des fonctions de localisation géographique. Ne pas se servir de ces fonctions n’affecte pas le bon fonctionnement de votre iPod touch. 4. iTunes Store et autres Services (Éléments de tierce partie). Le Logiciel de l'iPod touch active l'accès à l'iTunes Store d'Apple et à d'autres services et sites web proposés par Apple et par des tiers (lesquels services et sites sont dénommés sous l'appellation collective ou individuelle de « Services »). L'utilisation de ces Services requiert un accès à Internet et certains Services nécessitent l'acceptation de conditions de service complémentaires. Par l'utilisation de ce logiciel en lien avec un compte iTunes Store, vous acceptez les toutes dernières Conditions de Service iTunes Store, disponibles à l'adresse http://www.apple.com/legal/itunes/ww/. Vous acceptez qu'en utilisant ces Services vous pouvez rencontrer du contenu à caractère considéré injurieux, indécent ou choquant, n'étant pas nécessairement identifié comme tel et que les résultats de toute recherche ou toute saisie d'adresse URL peuvent automatiquement et involontairement créer des liens ou des références vers du contenu choquant. Vous acceptez toutefois d'utiliser les Services à vos propres risques et dégagez Apple de toute responsabilité envers vous quant au contenu pouvant être considéré injurieux, indécent ou choquant. Certains Services peuvent afficher, contenir ou mettre à disposition du contenu, des données, des informations, des applications ou des documents de tierce partie, (« Éléments de tierce partie ») ou fournir des liens vers des sites web de tierce partie. Résiliation. La présente Licence demeure valide jusqu'à résiliation. Après résiliation de cette Licence, vous devez cesser toute utilisation du Logiciel de l'iPod touch. 6. Exclusion de garanties. DANS LES LIMITES MAXIMALES AUTORISÉES PAR LA LÉGISLATION EN VIGUEUR, LE LOGICIEL DE L'IPOD TOUCH AINSI QUE TOUT SERVICE ASSURÉ PAR CELUI-CI SONT FOURNIS « TELS QUELS » ET « SELON DISPONIBILITÉ » AVEC TOUS LEURS DÉFAUTS ET SANS GARANTIE D'AUCUNE SORTE. APPLE ET LES CONCÉDANTS D'APPLE (COLLECTIVEMENT DÉSIGNÉS PAR L'EXPRESSION « APPLE » DANS LE CADRE DES ARTICLES 6 ET 7 DE LA PRÉSENTE LICENCE) EXCLUENT PAR LA PRÉSENTE LICENCE TOUTE GARANTIE ET CONDITION RELATIVE AU LOGICIEL DE L'IPOD TOUCH ET AUX SERVICES, EXPLICITE, TACITE OU LÉGALE, Y COMPRIS, MAIS DE FAÇON NON LIMITATIVE, LES GARANTIES IMPLICITES ET/OU LES CONDITIONS DE QUALITÉ MARCHANDE, DE QUALITÉ SATISFAISANTE, D'ADÉQUATION À UN USAGE PARTICULIER, D'EXACTITUDE, DE JOUISSANCE PAISIBLE ET DE NON-VIOLATION DES DROITS DES TIERS. APPLE NE GARANTIT NULLEMENT L'ABSENCE DE PROBLÈMES LORS DE L'UTILISATION DU LOGICIEL DE L'IPOD TOUCH ET DES SERVICES, QUE LES FONCTIONS, OU LES SERVICES CONTENUS DANS LEDIT LOGICIEL, CORRESPONDRA À VOS BESOINS, QUE LE FONCTIONNEMENT DUDIT LOGICIEL ET DESDITS SERVICES SERA ININTERROMPU OU EXEMPT D'ERREUR, QUE TOUT DÉFAUT DU LOGICIEL DE L'IPOD TOUCH OU DES SERVICES SERA CORRIGÉ, OU QUE LE LOGICIEL DE L'IPOD TOUCH SERA COMPATIBLE OU FONCTIONNERA AVEC UN LOGICIEL, UNE APPLICATION OU UN SERVICE DE TIERCE PARTIE. IL SE PEUT QUE L'INSTALLATION DE CE LOGICIEL AFFECTE LE BON FONCTIONNEMENT DE LOGICIELS DE TIERCE PARTIE. AUCUNE INFORMATION OU AUCUN CONSEIL COMMUNIQUÉ VERBALEMENT OU PAR ÉCRIT PAR APPLE OU L'UN DE SES REPRÉSENTANTS AUTORISÉS NE POURRA CONSTITUER UNE GARANTIE. SI LE LOGICIEL DE L'IPOD TOUCH OU LES SERVICES S'AVÉRAIENT DÉFECTUEUX, VOUS ASSUMERIEZ SEUL L'INTÉGRALITÉ DU COÛT DE TOUT DÉPANNAGE, TOUTE RÉPARATION OU RECTIFICATION NÉCESSAIRES. CERTAINES LÉGISLATIONS NE PERMETTANT NI L'EXCLUSION DE GARANTIES IMPLICITES, NI LES RESTRICTIONS AUX DROITS DES CONSOMMATEURS EN VIGUEUR, IL EST POSSIBLE QUE L'EXCLUSION ET LES LIMITES MENTIONNÉES CI-DESSUS NE VOUS CONCERNENT PAS. 7. Limitation de responsabilité. CERTAINES JURIDICTIONS NE PERMETTANT PAS LA LIMITATION DE LA RESPONSABILITÉ POUR DOMMAGES CORPORELS, INDIRECTS OU ACCESSOIRES, IL EST POSSIBLE QUE CETTE LIMITATION NE VOUS CONCERNE PAS. L’UTILISATION DE CERTIFICATS NUMÉRIQUES RESTE À VOS RISQUES ET PÉRILS. APPLE NE DONNE AUCUNE GARANTIE OU REPRÉSENTATION, EXPRESSE OU IMPLICITE, QUANT À LA QUALITÉ MARCHANDE OU L’ADÉQUATION À UN USAGE PARTICULIER, LA PRÉCISION, LA SÉCURITÉ OU LA NON VIOLATION DES DROITS DE TIERS CONCERNANT LES CERTIFICATS NUMÉRIQUES. Vous acceptez que (a) vous ne falsifierez ou n'utiliserez aucun certificat à mauvais escient ; (b) vous utiliserez les certificats numériques uniquement à des fins légales et en accord avec la Politique applicable aux certificats, la Déclaration des pratiques de certification ou autres expressions de pratiques commerciales en accord avec l’Autorité de certification ; (c) vous êtes seul responsable de l'interdiction d'usage non autorisé de vos certificats numériques ; et (d) vous révoquerez tout certificat dont la fiabilité n’est plus garantie. 9. Contrôle des exportations. Vous ne pouvez utiliser, exporter ou réexporter le Logiciel de l'iPod touch que conformément à la législation des États-Unis et à la législation du pays ou des pays dans lesquels vous avez acquis le Logiciel de l'iPod touch. Gouvernement des États-Unis. Bénéficiaire de la tierce partie. Certaines parties du Logiciel de l'iPod touch peuvent utiliser ou comporter des logiciels de tierces parties et des mentions concernant les droits d'auteurs. Les remerciements, les conditions des licences et les exclusions de garanties desdits éléments figurent dans la documentation électronique du logiciel de l'IPod touch, et l'utilisation de ces données est dictée par leurs conditions respectives. 14. Utilisation de MPEG-4. La licence couvrant le Logiciel de l'iPod touch vous est concédée en accord avec les conditions de la licence du portefeuille de brevets des systèmes MPEG-4 pour l'encodage selon la norme des systèmes MPEG-4. Une licence additionnelle et le paiement d'une redevance sont toutefois nécessaires pour l'encodage (i) de données stockées ou dupliquées sur un support physique payé titre par titre et/ ou (ii) de données payées titre par titre et transmises à un utilisateur final pour un stockage et/ou une utilisation permanents. Le Logiciel de l'iPod touch prévoit des fonctionnalités d'encodage et/ou de décodage MPEG-4.
