Communication access by deafand hearing-impaired persons as impactedby physical barriers such as inappropriate telephone and audio equipment is also included in these matrices. Barrierremoval in employee and unoccupied spaces is not a required part ofthis Plan. However, this ADA does not remove the Department ofConvention Facilities obligation under Title 11 ofthe to provide qualified disabled employees with reasonable accommodations. These accommodations may include architectural barrier removal. An inventory ofall architectural barriers (located in public and employee areas) is available in documents entitled "Disabled Access Survey Form Civic Auditorium dated 1-28-93 and Brooks Hall dated 10-30-92". These surveys were developed and conducted by the City ofSan Francisco's Department ofPublic Works' Bureau ofArchitecture. The Department ofConvention Facilities, underthe direction ofJack Moerschbaecher, operates three facilities which offer public programs: Civic Auditorium, Brooks Hall and the Moscone Center. Due to the unique physical characteristics ofeach facility, a separate Transition Plan is being developed forthe Civic Auditorium/Brooks Hall site and Moscone Centerrespectively. 1 Purpose This Transition Plan will describe architectural barriers and propose structural changes that will eliminate those barriers and ensure that individuals with disabilities have access to public programs offered by the City ofSan Francisco's Department ofConvention Facilities at the Civic Auditorium and Brooks Hall. It shall be used in conjunction with a Self-Evaluation, which evaluates program access, as a guide for the transition to full program access. The Americans with Disabilities Act ("ADA") bans discrimination by public entities in any ADA program, service, or activity offered to the general public. The requires that each program, "when viewed in its entirety, is readily accessible to and usable by individuals with disabilities". As a public entity, the Department ofConvention Facilities is required to provide access to all ofits programs but it is not required to remove all architectural barriers in its facilities. Public entities can choose either administrative solutions (such as relocating a program) and/or architectural barrier removal solutions to achieve program accessibility. However, a public entity is not required to make changes that would "result in a fundamental alteration in the nature ofa service, program, or activity, or in undue financial and administrative A burdens." written finding of"fundamental alteration" or "undue burden" must be documented by the head ofthe public entity, or his or her designee, after considering all resources available in the funding and operation ofthe program. There are no procedures forreceiving exceptions or hardship ADA determinations from the federal government. Currently enforcement is achieved through federal investigation ofcomplaints Irom the public or through private lawsuits. Public review of ADA steps toward compliance may, therefore, not only indicate areas ofmost concern to the disabled community but may avoid any future registered complaints or lawsuits. This Draft Transition Plan and the Draft Self-Evaluation shall be made available for public inspection and comment to interested persons, including those with disabilities and organizations representing individuals with disabilities. Public input through this Transition Plan will assist the Department ofConvention Facilities in assuring compliance with the letter and intent ofthe ADA. 2
