customaryinternationallaw Customaryinternationallaw,althoughlongrecognizedasaprimarysourceofinter- national law, remains replete with enigmas, both conceptual and practical. These includehowtodeterminetheexistenceofopiniojuris,thefunctionofthestateprac- ticerequirement,thedefinitionofjuscogenscustomarynorms,andtherelationship between customary international law and ethics. In part because of these enigmas, thesubjecthasgeneratedawide-rangingliterature.However,norecentbook-length workhasattemptedtoarticulateacomprehensivetheoryofcustomaryinternational lawthatcaneffectivelyresolvethesequestions. Thisbooksetsouttoaccomplishthisgoal.Itsapproachisuniqueinanumberof ways.Forexample,itismultidisciplinaryanddrawsinsightsfromfieldssuchaslegal theory,philosophy,politicalscience,andgametheory.Inaddition,itisanchoredina sophisticatedethicalframeworkandexploresatlengththeinterconnectionsbetween customaryinternationallawandethics. Brian D. Lepard is Law Alumni Professor of Law at the University of Nebraska CollegeofLawandcodirectoroftheuniversity’sHumanRightsandHumanDiversity Initiative.
