Eleven participants in the training exercise sought orders restraining the Commonwealth authorities from disclosing their names to the Victoria Police, who were investigating whether crimes had been committed. The participants relied upon a term of their employment that their identities would be kept confidential. ISSUE Was the confidentiality term unenforceable on public policy grounds? DECISION Relief was denied. Enforcement of the term would be contrary to public policy, since it had the tendency to affect adversely the administration of the criminal law.
