Delegation of Mr. Neil Davis, Davis Webb Schulze and Moon, re: DIRECTION TO APPEAL COMMITTEE OF ADJUSTMENT APPROVAL OF CONSENT APPLICATION B47/99 - DONALD REID AND ANNE HOSKINS - PART OF LOT 14, CONCESSION 5 W.H.S. - WARD 6 (File G32 / B47/99)(See Item G1). Mr. Neil Davis appeared before Committee to request the decision of the Committee of Adjustment be upheld, and the appeal from the City of Brampton withdrawn. Committee was informed that the applicants are farming the land and currently live on another property. The purpose of the severance is to allow the severed property to be mortgaged separately from the agricultural land. Discussion took place regarding moving the driveway access to the property to another location when and if the area is developed. Item G1 was brought forward and dealt with at this time. PB006-2001 That the delegation of Mr. Neil Davis, Davis Webb Schulze and Moon, to the Planning and Building Committee Meeting of January 8, 2001, re: DIRECTION TO APPEAL COMMITTEE OF ADJUSTMENT APPROVAL OF CONSENT APPLICATION B47/99 - DONALD REID AND ANNE HOSKINS - PART OF LOT 14, CONCESSION 5 W.H.S. - WARD 6 (File G32 / B47/99) be received; and, That the report from J. Hardcastle, Development Planner, Planning and Building Department, dated January 3, 2001, to the Planning and Building Committee Meeting of January 8, 2001, re: DIRECTION TO APPEAL COMMITTEE OF ADJUSTMENT APPROVAL OF CONSENT APPLICATION B47/99 - DONALD REID AND ANNE HOSKINS - PART OF LOT 14, CONCESSION 5 W.H.S. - WARD 6 (File G32 / B47/99) be received; and, That the decision of the Committee of Adjustment regarding application B47/99 not be appealed to the Ontario Municipal Board; and, That access be incorporated into the future development area and removed from Mississauga Road. CARRIED Direction was given to staff to work with Mr. Davis in drafting a condition of the consent that would ensure the effective integration of a dwelling and related access into the eventual urban subdivision that will occur in this area. 2001 01 08 Page 6 of 10 MINUTES Planning and Building Committee E 2. Delegation of Mr. Bob Lackey, Candevcon Limited, re: DIRECTION TO APPEAL COMMITTEE OF ADJUSTMENT APPROVAL OF CONSENT APPLICATION A266/00 - ONTARIO HYDRO TRANSMISSION COMPANY - PART OF LOT 14, CONCESSION 2, W.H.S. - WARD 4 (File G31 / A266/00)(See Item G2). Mr. Bob Lackey, Candevcon Limited, appeared before Committee to request the appeal of the Committee of Adjustment decision be withdrawn. He informed Committee that the applicant is willing to landscape the 9 metre buffer zone to the north of the subject land and incur the costs associated with the development of overflow parking and installing a cross walk on McLaughlin Road. Item G2 was brought forward and dealt with at this time. PB007-2001 That the delegation of Mr. Bob Lackey, Candevcon Limited, to the Planning and Building Committee Meeting of January 8, 2001, re: DIRECTION TO APPEAL COMMITTEE OF ADJUSTMENT APPROVAL OF CONSENT APPLICATION A266/00 - ONTARIO HYDRO TRANSMISSION COMPANY - PART OF LOT 14, CONCESSION 2, W.H.S. - WARD 4 (File G31 / A266/00) be received; and, That the report from J. Hardcastle, Development Planner, Planning and Building Department, dated January 3, 2001, to the Planning and Building Committee Meeting of January 8, 2001, re: DIRECTION TO APPEAL COMMITTEE OF ADJUSTMENT APPROVAL OF CONSENT APPLICATION A266/00 - ONTARIO HYDRO TRANSMISSION COMPANY - PART OF LOT 14, CONCESSION 2, W.H.S. - WARD 4 (File G31 / A266/00) be received; and, That the decision of the Committee of Adjustment regarding application A266/00 not be appealed to the Ontario Municipal Board as the Nanaksar Gurdwara requires event overflow parking from 7:00 p.m. to 11:00 p.m. one or two days per month; and That a flashing light for pedestrian access across McLaughlin Road be a prerequisite of the Site Plan Approval and that all costs incurred to the development of the overflow parking and cross walk be paid by the applicant. CARRIED E 3. Delegation of Mr. Michael Gagnon, Gagnon Law Bozzo Urban Planners Ltd., representing Rogers AT&T Wireless, New Site Development Department, re: PUBLIC UTILITIES (File P42GE-1). Mr. Gagnon appeared before Committee to request being allowed to work with staff regarding problems that may arise through the process as the Radiocommunication and Telecommunications Acts have not transferred the rights to regulate to the municipality. Mr. Gagnon informed Committee that he does not wish to hold the process up, is in favour a public meeting being held and is working towards having a presentation available for Committee at the time of the public meeting. Staff confirmed that there must be a public meeting in this regard. Item J1 was brought forward and dealt with at this time. PB008-2001 That the delegation of Mr. Michael Gagnon, Gagnon Law Bozzo Urban Planners Ltd., representing Rogers AT&T Wireless, New Site Development Department, to the 2001 01 08 Page 7 of 10 MINUTES Planning and Building Committee Planning and Building Committee Meeting of January 8, 2001, re: PUBLIC UTILITIES (File P42GE-1) be received; and, That the report from B. Lee, Director, Urban Design and Zoning, Planning and Building Department, dated January 2, 2001, to the Planning and Building Committee Meeting of January 8, 2001, re: PUBLIC UTILITIES (File P42GE-1) be received; and, For the purpose of (1) providing consistent provisions among all City comprehensive zoning by-laws with respect to utilities, (2) accommodating private utility companies, and (3) addressing streetscape matters without the necessity of obtaining individual variance approval from the Committee of Adjustment, staff be directed to take appropriate procedures to amend City zoning by-laws with respect to public uses to the following; including holding a public meeting in this regard: “The provisions of this by-law shall not apply to prevent the use of any land or the erection or use of any building, structure, plant, or equipment by a public authority or a gas, electric, telecommunications, cable, or other utility company regulated by a provincial or federal agency for any undertaking essential to the transmission and distribution (not including generation) of utilities including energy, signal, electricity, water and sewer; and such use or erection may be permitted subject to the following requirements and restrictions: (a) other than an electric power transmission line, the size, height, coverage and yard regulations required for the zone in which such land, building, structure, plant, or equipment is located shall be complied with except for a facility less than 1 square metre in area and 2 metres in height, which may be located not less than 3 metres from a public road right-of-way and 1.5 metres from any other property line; (b) no goods, material or equipment may be stored in the open in a Residential Zone or in a lot abutting a Residential Zone; (c) any parking and loading regulations prescribed for these uses shall be complied with; (d) areas not used for parking, driveways or storage shall be landscaped; and (e) all electric power facilities of Hydro One Inc. and Brampton Hydro Networks Inc. existing on the date of enactment of this by-law shall be deemed to conform with the requirements and restrictions pertaining to the particular zone in which it is located.
