The following are our comments: I. A permit from CCEHD is required for any well or soil boringprior to commencing drilling activities, including those associated with environmental 1 investigation and cleanup, and geotechnical investigation. 2. Any abandoned wells (water, environmental, or geotechnical) and septic tanks must be destroyed under permit from CCEHD. If the existence of such wells or 2 septic tanks are known in advance or discovered during cons!ntction or other activities, these should be clearly marked, kept secure, and destroyed pursuant to CCEHO requirements. CA 94804 Dear Ms. Velasco: Chevron Refinery Modernhation Project-· Draft Environmental Impact Report (DElR) Thank you tbr continuing to include the California Department of Transportation (Caltrans) in the environmental review process for the project refert;nced above. We have reviewed the environmental docwnent and have the following comments to offer. Impact 4.16-1 on page 4.16 ... 21 notes that the DEJR evaluates the impact of the increased traffic on intersections including ramps. Chevron states that they will work with the City ofruchmond Public Works Department and Caltrans to provide modified traffic·control implemented at the intersection to improve the traffic flow at the PM peak hou,r. This 1 proposed mitigation measure would imp.f()ve the local. traffic condition, hut CQuld cause queuing on freeway by allowing excess amount of traffic <;mtering the freeway via on ramp. The DEIR should also address how the proposed mitigation measure would affect the freeways during the construction. Impact 14.1.6.1 on page 4.16-21, the DEIR states that.darnages resulting from heavy truck traffic on area roadways will be repaired by Chevron. Please also state how the·e xisting 2 condition wiJl be documented~ who will docwnent it, and how the damage will be evaluated by and within what time period after the completion of the project. Table 4.16~6 and Table 4.16-7 on pages 4.16~20 and 4.16··2 shows the PM peak hour delay for Castro Street/1-580 Eastbound Ramps baseline condition and baseline plus project 3 construction conditions being the same. Please check if this is the maximum delay that the mod.el produces or reflects no changes in delay. The California Public Utilities Code requires Commission approval for the construction or alteration of crossings and grants the Commission exclusive power on the design, alteration, and closureof crossings. The Commission’s Rail Crossings Engineering Section (RCES) is in receipt oftheDraft Environmental Impact Report (DEIR)fortheproposedChevron Refinery Modernization project. The City ofRichmond(City) is the lead agency. According to theDEIR, theCityproposes tomodernize the existing Chevron refinery by improving efficiency and capacity. TheBNSF Railway(BNSF)Richmond yard is located immediately east of the refinery. There are two spur crossings entering the facility from the BNSF yard. These two crossings are identified as: Castro St, CPUC No. 132AAC-1.45-C, CC-1272, Federal DOT No. 751690B Richmond Ln. CPUC No. 132-0.15-C, CC-1050, Federal DOT No. 768293E All construction located near the rail track within the project site must comply with the Commission’s General Orders (GO). Details on the Commission’s General Orders are located herehttp://www.cpuc.ca.gov/crossings. These General Orders consist of:  GO 26-D: Clearances on railroads and street railroads as to side and overhead structures, parallel tracks and crossings 1  GO 72-B: Construction & Maintenance-Standard types of pavement construction at railroad grade crossings  GO 75-D: Warning Devices for at-grade railroad crossings  GO 88-B: Alterations of railroad crossings  GO 118: Construction, reconstruction and maintenance of walkways and control, of vegetation adjacent to railroad tracks During past inspections, RCES staff noted neither of the above referencedhighway-rail at-grade crossings had the required Emergency Notification Information. GO 75-D Section 5 states: 5. IDENTIFICATION OF PUBLIC AT-GRADE CROSSINGS 5.1 Each public at-grade crossing, or publicly used private at-grade crossing (as determined bythe Commission or a court of competent jurisdiction), except those Lina Velasco Submittal April 14, 2014 A3 Page 2 of 4 Cont listed in Section 5.2, shall have the following information posted conspicuously and legibly at the crossing by the entity responsible for its maintenance: a) The Commission and/or U.S. Department of Transportation assigned number that uniquely identifies the at-grade crossing; and b) Emergency notification telephone number. Neither crossing is compliant with GO 75-D as the emergency information is incomplete. The Castro St spur crossing only has a historical CPUC No. and a partial Federal DOT No. posted on the signal box.
