BOW TOWN MEETING BOW SCHOOL DISTRICT MEETING MODERATORS' RULES OF PROCEDURE Unless changed by the voters at the Meetings, the Town and School Moderators will use the following Rules ofProcedure to conduct the respective Meetings: 1 The Moderatorwill not follow Robert's Rules. The Moderatorwill usethe follow- inggeneralrules ofprocedure, whosemainpurpose istokeepthemeetingmoving, and not get bogged down in procedural quagmires. 2. By majority vote, the voters can overrule any decision that the Moderator makes and any rule that the Moderator establishes. A voter can raise such a request by Point ofOrder. 3. TheModeratorwilltakeArticles intheorderthattheyappearonWarrantunlessthe Moderator announces the intent to takeArticles out oforder. 4. The Moderatorwill considereachArticle, as follows: a. The Moderator will announce the Article number, and the text ofthe Article willbe displayedonthe overhead screen. The Moderatorwill notreadthe full text oftheArticle unless it has been amended. b. The Moderator will recognize a member ofthe Budget Committee or ofthe Board of Selectmen, or the petitioner (if a petitioned Article) to move the adoption oftheArticle. c. If the Motion is seconded, the Moderator will recognize a member of the Board ofSelectmen orthe petitionerto explain theArticle. d. The Meeting will debate and then vote on theArticle. 5. Everyonewho speaksmustuseamicrophone soyoucanbeheard. (TheModerator will announce the location ofthe microphones in the Meeting room.) Ifyou are unable to reach one ofthe stand-up microphones, raise your hand and one ofthe hand-held microphones will be brought to you. 6. No one may speak unless they have the floor. a. No one may have the floorunless recognized by the Moderator. b. Except for Points ofOrder, the Moderator will not recognize you unless you are standing at orholding one ofthe microphones. c. Whenever you speak or make motion or second, please give your name and address. d. Even ifyou do not have the floor, you may speak to raise a Point ofOrderto challenge a Moderator's ruling orto overrule the Moderator. 7. The Moderator will allow only one motion on the floor at a time. There are two exceptions to this rule: . a. You may raise Points ofOrder at any time, and b. Ifyou have the floor, you may make i. A motion to amend the pending motion, or ii. A motion to Call the Question. 8. All amendments and motions must be in writing, except technical changes to a printedArticle, Points ofOrder, orMotions to Call the Question. 9. The Moderator will not accept negative motions, which are motions that require a "no" vote to vote inthe affirmative such as "I move thatwe not adoptthe budget." 10. Motions to Call the Question limit debate and require a 2/3 vote. Ifpassed, these motions stop debate on a motion, however, all those voters who are standing at a microphone orholding a microphone, and anyone seated atthe headtable who has previouslytoldtheModeratorthattheywishtospeakontheMotionwillbeallowed to speak. 11 Non-voters may not speak at the Meeting without the permission of the voters except, the Moderator will allow non-resident Town officials and consultants or experts who are here to provide information about anArticle to speak. 12. All speakers must be courteous. The Moderatorwill not allow personal attacks or inappropriate language. 13. All questions andcomments shouldbe addressedtotheModerator. TheModerator will choose who responds to the questions. 14. With the exception of initial presentations on Articles which the Moderator requests be limited to ten (10) minutes, all speakers in debate will be limited to three (3) minutes. 15. Each speakermay only speak once until everyone has spoken. 16. Any vote on a bond issue ofover $100,000 must be voted on by secret ballot. In addition, any five (5) voters may request that the vote on anyArticle be by secret ballot. To do so: a. All five (5) voters must be present and identified, b. The request must be presented during or at the end ofdebate on the Article, and c. The request must be made by having one ofthe voters approach one ofthe microphones to be recognizedby the Moderator. 17. Motions to reconsider anArticle may only be made immediately after the vote on theArticle, andmayonlybe made by someone who voted onthe prevailing side of thevotetobereconsidered. However,thefollowing limitsmayapplytotherecon- sideration ofanArticle: a. MandatoryRestriction: Ifamotiontoreconsideraballotvoteon abondissue 6 ofover$100,000passes, inaccordancewith RSA33:8-a,theArticlecannotbe reconsidereduntil areconvenedMeetingthat isat leastseven(7)daysafterthe original vote. With respect to bond votes, the restriction on reconsideration automatically applies without the need for the Meeting to vote for it. b. Optional Restriction: Voters may postpone reconsideration ofany Article at this Meeting by voting to restrict reconsideration oftheArticle in accordance with RSA40:10. Ifthe Meetingpasses suchamotion, thentheArticle cannot be reconsidered until a reconvened meeting held at least seven (7) days after the date ofthe original vote. c. Reminder: Since anyrule ofthe Moderatorordecision ofthe Meeting canbe reversed orchangedat any time by amajority vote ofthe Meeting, there is no rule that can be adopted that can absolutely prevent the reconsideration ofan Article. 18. TheModeratormayvoteonallArticles. However,theModeratorplanstoonlyvote in two (2) instances: a. To break a tie b. To make a vote a tie vote ifa motionthe Moderator opposes would otherwise carry by one (1) vote. 19. Ifthe Meeting is not finished at 11:00, the Moderator will adjourn the Meeting to a future date. 20. TheModeratormayorderthepolicetoremove anyonewhoviolatestherules ofthe Meeting (RSA 40:8). . . VOTERS' RIGHTSAND RESPONSIBILITIES EveryVoter is responsible to: 1 Recognize that the Meeting is a legislative assembly where voters gather together to conduct business, and that the Moderator has volunteered to preside over the Meeting to bring orderto the process. 2. ReviewtheTownand SchoolReportsinadvanceoftheTownand School Meetings. 3. Seek answers to any questions that they have from the appropriateTown or School officials in advance ofthe Meetings. Attend informational sessions to learn the background of significant proposals and to ensure meaningful debate at the Meeting. 4. Become familiarwiththe Rules ofProcedure forthe Meetings which arepublished in theTown Report. 5. Give the Moderator fair warning ifyou would like to do anything out ofthe ordi- nary, like present slides oruse alternative rules ofprocedure. 6. Arrive early enough for the Meetings to allow sufficient time to check in and find a seat. 7. Be courteous to all officials, presenters, and othervoters. 8. Avoidpersonal attacks and inappropriate language. 9. Understand that occasional problems are to be expected when presenting informa- tion to or managing the movement oflarge numbers ofvoters, and be patient and courteous with officials and othervoters when they occur. 10. Be aware that since any rule ofthe Moderator or decision ofthe Meeting can be reversed orchanged at any time by a majority vote ofthe Meeting, there is no rule that can be adopted that can prevent reconsideration of an Article. Restricting reconsideration can onlypostpone the secondvote to a reconvenedmeeting held at least seven (7) days from the date ofthe original vote. 11 Remember that ifthe Moderator cancels a Meeting due to inclement weather, the decision will be communicated via the same radio andTV stations that the School District uses to announce school cancellations. 12. Help the Meeting to promptly complete the business onthe warrant.
