This report includes the analysis of voting trends, criminalization of politics, use of money power, gender disparities etc. in these elections. Information provided by the Election Commission of India and details from the affidavits filed by the candidates have been used for the analysis. Growth in number of candidates A total of 3,523 candidates contested the Bihar 2010 Assembly Elections as compared to 2,135 candidates in Bihar 2005 Assembly Elections. This shows a rise of 65% in the number of candidates contesting in 2010. Out of 3523 candidates in 2010, 3215 (91%) were men and 308 (9%) were women. In 2005, out of 2135 candidates, 1999 were men (94%) and 136 (6%) women. Executive summary of candidates and MLAs Summary of candidates • Bihar Election Watch (BEW) analyzed affidavits of 2235 candidates out of 3523 who contested 2010 Assembly Elections. • Out of these 2235 candidates analyzed, 797 candidates or 36% declared pending criminal cases against them.BJP had 66 out of 102 (65%) candidates with pending criminal cases, LJP had 42 out of 75 (56%), RJD had 92 out of 166 (55%), JD(U) had 76 out of 140 (54%), INC had 92 out of 240 (38%), BSP had 89 out of 232 (38%), and NCP had 30 out of 106 (28%) candidates with pending criminal cases. • Out of these 797 candidates with pending criminal cases, 467 had pending serious criminal cases like murder, attempt to murder, kidnapping, robbery, extortion etc. BSP had 58, JD (U) had 53, INC had 46, RJD had 46, BJP had 29, LJP had 23 • 723 candidates from five main parties i.e. JD(U), BJP, INC, RJD and LJP were analyzed and out of these, 368 (51%) had pending criminal cases against them. In Bihar 2005 Assembly Elections, 641 candidates were analyzed from these five major parties- (JD(U), BJP, INC, RJD and LJP ).Out of these 641 candidates of five major political parties, 288 (40%) had pending criminal cases against them. • There were 1293 IPC charges of heinous nature on the candidates. These included murder, attempt to murder, kidnapping, extortion, etc. • There were a total of 149 red alert constituencies (i.e. where 3 or more contesting candidates had pending criminal cases). • A total of 227 candidates out of 2235 analyzed i.e. 10% were crorepatis. • A total of 12 candidates out of 2235 analyzed declared zero assets. • A total of 263 candidates out of 2235 analyzed declared liabilities above 5 lakhs. • Among major parties, the average asset per candidate for RJD was approximate 1 crore, for INC was 94 lakhs, JD(U) was 85 lakhs, for LJP was 80 lakhs and for BJP was 66 lakhs. Candidates' affidavit with nomination papers is the source of this analysis. www.adrindia.org, www.myneta.info Page 3 of 149 • 64% of candidates (1440 of 2235 analyzed) had not furnished PAN card details. • Number of women candidates was just 308 (9%) as compared to 3215 of men candidates (91%). • More than 45% candidates (1001 of 2235 analyzed) were graduates & above. Summary of MLAs • Affidavits of 242 MLAs out of 243 MLAs were analyzed by BEW. • Out of 242 MLAs analyzed, 141 (58%) have pending criminal cases against them. Comparing this to Bihar 2005 Assembly Elections, out of 233 MLAs analyzed, 117 (50%) had pending criminal cases against them. • Out of these 141 (58%) MLAs with pending criminal cases, there are pending serious criminal cases against 85 MLAs (35%). Contrasting this with Bihar 2005 Assembly Elections, there were 117 MLAs with pending criminal cases out of which 68 MLAs (29 %) had serious pending criminal cases. • Of the 467 candidates with the most serious criminal cases against them, 85 won and the remaining 382 lost. • Out of 141 MLAs with pending criminal cases in Bihar Assembly Elections, 2010, there are 58 MLAs each from JD(U) and BJP, 13 from RJD, 3 each from INC and LJP, who have criminal cases pending against them. • MLAs with pending criminal cases have increased from 117 in Bihar 2005 Assembly Elections to 141 in Bihar 2010 Assembly Elections. The number of total criminal cases against MLAs has decreased from 441 in Bihar Assembly 2005 to 440 in Bihar Assembly 2010. • The number of total serious IPC sections against MLAs has decreased from 363 in 2005 to 267 in 2010. • The number of crorepati MLAs has increased from 8 (3%) in Bihar Assembly 2005 to 48 (20%) in Bihar 2010 Assembly Elections. • Among major parties, the average asset per MLA for RJD was Rs. 1 crores, for INC was Rs 93 lakhs, for JD(U) was Rs. 84 lakhs and for BJP, it was Rs. 64 lakhs. • The Average asset for a MLA from Bihar was Rs 80.69 lakhs. • Out of 242 MLAs analyzed, 76 had not declared their PAN details. • Out of 308 women candidates, only 34 won.
