1 SEC.2.ANESTHESIAOUTCOMESTUDY.
2 (a) Study.—(1) The Secretary- of Health and
3 Human Sendees shall conduct a study of mortality and
4 adverse outcome rates ofMedicare patients byproviders
5 ofanesthesia services. In conductingthe study, the See-
6 retary shall analyze the impact ofphysician supervision
7 ofprovidersofanesthesiaservices,orlackthereof,onsuch
8 mortalityandadverseoutcomerates.
9 (2) Inconductingthestudy, the Secretaryshallcon-
10 suit with appropriate national professional organizations
11 ^^ath respect to the methodology^ ofthe studj^, and shall
12 useMedicareoperatingroomanesthesiadata,adjustedfor
13 patientacuityandotherrelevantscientificvariables.
14 (b) Report.—Not later than June 30, 2000, the
15 SecretaryshallsubmittoCongressareportcontainingthe
16 resultsofthestudyconductedundersubsection(a).

17 (c) Consideration ofReportinRulemaking.
18 The Secretary- shall consider the results of such study
19 wliendeterminingifanymodificationorchangetotheex-
20 istingMedicareregulationsineffectonJanuary 1, 1999,
21 deahngwith physician supervision ofanesthesia services
22 maybeappropriate.
