It shallbethe dutyofthe TaskForce 11 toconductacomprehensivelegalandfactualstudyofthe 12 followingmatters: 13 (1) Promises, commitments, or representations 14 madeto members oftheUniformed ServicesbyDe- 15 partment of Defense personnel with respect to 16 healthcarecoverageofsuchmembersandtheirfam- 17 iliesafterseparationfromtheUniformedServices. 18 (2) Sharing agreements and contracts between 19 the Department ofDefense and the Department of 20 Veterans Affairs regarding health care coverage for 21 militaryretireesandtheirdependents. 22 (3) Proposalstoprovideforafullcontinuumof 23 health care coverage for medicare ehgible military 24 retirees and their dependents, including any such 25 proposaldevelopedbytheDepartmentofDefense. •HR4464IH 3 — 1 (b)Report. NotlaterthanoneyearaftertheTask 2 Force first meets, the Task Force shall submit a report 3 to Congress which shall contain a detailed statement of 4 findings and conclusions ofthe Task Force with respect 5 to the studies conducted under subsection (a), together 6 withitsrecommendationsforsuchlegislativeandadminis- 7 trativeactionsasitconsidersappropriate. 8 SEC.4.MEMBERSHIP. — 9 (a) NumberandAppointment. The Task Force 10 shall be composed of 12 members appointed as follows: 11 (1) The Speaker ofthe House of Representa- 12 tives andthe minorityleader ofthe House ofRep- 13 resentatives shalljointlyappointninemembersfrom 14 amongqualifiedindividualsasfollows: 15 (A) Two members shall be representatives 16 ofveteransserviceorganizations. 17 (B) Three members shall be representa- 18 tives of military associations with retired en- 19 hstedmembers. 20 (C) One member shall be a representative 21 ofaretiredofficersassociation. 22 (D) Three members shall be health care 23 professionals. m •HR4464 4 1 (2) The SecretaryofDefense shall appoint one 2 member from among officers or employees of the 3 DepartmentofDefense. 4 (3) The SecretaryofVeteransAffairs shall ap- 5 pointonememberfromamongofficersoremployees 6 oftheDepartmentofVeteransAffairs. 7 (4) The SecretaryofHealth andHuman Serv- 8 ices shall appoint one member from among officers 9 or employees of the Department of Health and 10 HumanServices. 11 (5) Notmorethan 6 members appointedunder 12 this subsection may be ofthe same political party. — 13 (b)DeadlineforAppointment. Membersofthe 14 TaskForce shallbe appointedbynotlaterthan 90 days 15 afterthedateoftheenactmentofthisAct. — 16 (c) TermsofAppointment. Thetermofanyap- 17 pointment under subsection (a) to the Task Force shall 18 beforthelifeoftheTaskForce. — 19 (d)Vacancies. ^Anymemberappointedtofillava- 20 cancyoccurringbeforetheexpirationofthetermforwhich 21 the member's predecessor was appointed shall be ap- 22 pointed only for the remainder ofthat term. Avacancy 23 inthe TaskForce shallbefilledinthe mannerinwhich 24 theoriginalappointmentwasmade. >HR4464IH 5 1 (e)WatvterofLimitation onExecutive Sched- — 2 ulePositions. Appointments maybemadeunderthis 3 sectionwithoutregardtosection5311(b)oftitle5,United 4 StatesCode. — 5 (f) Continuation of Membership. Ifa member 6 wasappointedtotheTaskForceasaMemberofCongress 7 andthe member ceases to be a Member ofCongress, or 8 wasappointedtotheTaskForcebecausethememberwas 9 not an officer or employee ofany government and later 10 becomes an officer or employee of a government, that 11 membermaycontinueasamember. — 12 (g) Compensation. Members of the Task Force 13 shallreceiveno additionalpay, allowances, orbenefitsby 14 reasonoftheirserviceontheTaskForce. — 15 (h) Expenses. Each Member of the Task Force 16 shaUreceivetravel expenses andperdieminlieuofsub- 17 sistenceinaccordancewithsections5702and5703oftitle 18 5,UnitedStatesCode. — 19 (i) Quorum. Seven members of the Task Force 20 shall constitute a quorumbut alesser numbermayhold 21 hearings. • » — 22 (j) Chairperson. Asthefirstorderofbusinessat 23 the first meetingofthe TaskForce, the members ofthe 24 Task Force shaU elect a chairperson from among the 25 members. .. •HR44G4IH >• i 6 — 1 (k) Meetings. The Task Force shall meet at the 2 calloftheChairpersonoramajorityofitsmembers. 3 SEC.5.STAFFOFTASKFORCEANDSUPPORTSERVICES. — 4 (a) Director. The Task Force shall, without re- 5 gard to section 5311(b) oftitle 5, United States Code, 6 have a Director who shall be appointed by the Chair- 7 person.TheDirectorshallbepaidattheminimumannual 8 rateofbasicpaypayableforGS-15oftheGeneralSched- 9 ule. — 10 (b) Staff. WiththeapprovaloftheChairpersonof 11 theTaskForce,theDirectormayappointandfixthepay 12 ofnotmorethaneightadditionalpersonnel. 13 (c) Applicability of Certain Civil Ser\ice — 14 Laws. The staff ofthe Task Force maybe appointed 15 withoutregardtotheprovisions oftitle 5, United States 16 Code, governing appointments inthe competitive service, 17 andmaybepaidwithoutregardtotheprovisionsofchap- 18 ter51andsubchapterIIIofchapter53ofthattitlerelat- 19 ingto classification and General Schedule payrates, ex- 20 ceptthatanindividual so appointed maynotreceivepay 21 inexcessoftheminimumannualrateofbasicpaypayable 22 forGS-13oftheGeneralSchedule. — 23 (d) Staff of Federal Agencies. Upon request 24 oftheChairperson,theheadofanydepartmentoragency 25 oftheUnited Statesmaydetail, onareimbursablebasis, •HR4464IH 7 1 anyofthepersonnelofthatdepartmentoragencytothe 2 Task Force to assist it in carrying out its duties under 3 thisAct. 4 SEC.6.POWERSOFTASKFORCE. 5 (a) Hearings and Sessions—The Task Force 6 may, forthepurposeofcarryingoutthisAct, holdhear- 7 ings, sitandactattimesandplaces,taketestimony, and 8 receiveevidenceastheTaskForceconsidersappropriate. — 9 (b)PoAMERSOFMembersandAgents. ^Anymem- 10 beroragentoftheTaskForcemay, ifauthorizedbythe 11 TaskForce, takeanyactionwhichtheTaskForceisau- 12 thorizedtotakebythissection. — 13 (c) Obtaining Official Data. The Task Force 14 maysecuredirectlyfromanydepartmentoragencyofthe 15 United Statesinformationnecessarytoenable ittocarry 16 outthisAct.UponrequestoftheChairpersonoftheTask 17 Force,theheadofthatdepartmentoragencyshallfamish 18 thatinformationtotheTaskForce. — 19 (d) Mails. The Task Force may use the United 20 Statesmailsinthesamemannerandunderthesamecon- 21 ditions as otherdepartments and agencies ofthe United 22 States. — 23 (e) Administrative Support Services. Upon 24 therequestoftheTaskForce, theAdministratorofGen- 25 eral Services shallprovidetothe TaskForce, on areim- •HR4464ra g 3 flDTH D0I6^77 L 1 bursable basis, the administrative support services nee- 2 essaryfortheTaskForcetocarryoutitsresponsibilities 3 underthisAct. — 4 (f) Contract Authority. The Task Force may 5 contract with and compensate government and private 6 agenciesorpersonsforsuppUesorservices,withoutregard 7 to section 3709 ofthe Revised Statutes (41 U.S.C. 5). 8 SEC.7.TERMINATION. 9 TheTaskForceshallterminate90daysaftersubmit- 10 tingthereportundersection3(b).
