IN THE HOUSE OF REPRESENTATIVES September9,1988 Mr.Starkintroducedthefollowingbill;whichwasreferredtotheCommittee onWaysandMeans A BILL ToamendtitleXVIIIoftheSocialSecurityActtorectify overpaymenttocertainlong-termcarehospitals. 1 BeitenactedbytheSenateandHouseofRepresenta- 2 tivesoftheUnitedStatesofAmericainCongressassembled, 3 SECTION1.SHORTTITLE. 4 ThisActmaybe citedasthe "MedicareLong-Term 5 CareHospitalPaymentCorrectionActof1998". 6 SEC.2.ADJUSTMENTINPAYMENTAMOUNTTOLONG-TERM 7 CAREHOSPITALS. — 8 (a)InGeneral. Section 1886(b) oftheSocialSe- 9 curityAct(42U.S.C.1395ww(b))isamended— — 2 1 (1) in paragraph (1)(A), by inserting "subject 2 to paragi-aph (8)" before "are less than or equal to 3 thetargetamount";and 4 (2) by adding at the end the following new \ 5 paragraph: 6 "(8)(A) Notwithstandingparagraph (1), inthe case 7 of a hospital described in subsection (d)(l)(B)(iv), the 8 Secretaryshallcompare 9 "(i)theaverageinpatientlengthofstayofsuch 10 hospital during the cost reporting period described 11 inclause(i)or(ii) ofparagraph(3)(A),and 12 "(ii) the average inpatient length of stay of IS such hospital during the two cost reporting period 14 beginningforwhich the Secretaryhas the most re- 15 centsettledcostreportforthehospital. 16 , "(B)IftheSecretarydeterminesthattheaveragein- 17 patient length of stay described in subparagraph (A)(ii) 18 is5percentlessthantheaverageinpatientlengthofstay 19 described in subparagraph (A)(i), the target amount for 20 suchhospitalforthecostreportingperiodbeginningdur- 21 ingthe current fiscalyear shall be equal to the product 22 of— 23 "(i) the target amount for the cost reporting 24 perioddescribedinsubparagraph(A)(i), and •HR4533m — 3 1 "(ii) the fraction (expressed as a percentage), 2 thenumeratorofwhichisthetargetamountforthe * 3 cost reporting period described in subparagraph ^ 4 (A)(ii), and the denominator ofwhich is the target 5 amount for the cost reporting period described in 6 subparagraph(A)(i).". 7 (b) ConsiderationofLengthofStayinLong- 8 TermCareProspectivePayment SystemProposal — 9 Under Balanced Budget Act of 1997. Section 10 4422(a)(2) ofthe Balanced BudgetAct of 1997 (Pubhc 11 Law105-33)isamended 12 (1) in subparagraph (A), by striking "and" at 13 theend; 14 (2) insubparagraph (B), bystrikingtheperiod 15 andinserting and"; and 16 (3)byaddingattheendthefollowdngnewsub- 17 paragraph: 18 "(C) shall consider adjustmentsinamount 19 ofpayments to long-term care hospitals whose 20 averageinpatientlengthofstayduringthebase 21 yeargreatlyexceedsthehospitals' averageinpa- 22 tientlengthofstayinlateryears.". <HR4533IH 4 3 fiOTS DDOiflHfll a — 1 (c) Effective Date.
