Section 1861 ofthe Social Secu- 9 rityAct(42U.S.C. 1395x),asamendedbysection152(b) — 2 1 oftheMedicareImprovementsforPatientsandProviders 2 Actof2008(PublicLaw110-275),isamended— 3 (1)illsubsection (s)(2) 4 (A) by striking "and" at the end of sub- 5 paragraph (DD); 6 (B) by adding: "and" at tlie end of sub- 7 paragraph(EE);and 8 (C)byadding:attheendthefoUowing'new 9 subparagraph: 10 "(FF) home infusion therapy (as defined in 11 subsection (hhh)(l));"; and 12 (2) byaddingattheendthefollowingnewsub- 13 section: 14 "HomeInfusionTherapy 15 "(hhh)(l) The term 'home infusion therapy' means 16 thefollowingitemsandservicesfurnishedtoanindi\adual, 17 who isunderthe care ofaphysician, which areprovided 18 byaqualifiedhomeinftisiontherapyproviderunderaplan 19 (forfurnishingsuchitemsandservicestosuchindi\adual) 20 establishedandperiodicallyre\iewedbyaphysician,which 21 items and services are provided in an integrated manner 22 in the indixidual's home in conformance with uniform 23 standardsofcareestablishedb}-the Secretary"(aftertak- 24 inginto account the standards commonlyused for home 25 infiisiontherapybyMedicareAdvantageplansandinthe •S3505IS 3 1 private sector and after consultation with all interested 2 stakeholders) and in coordination with the provision of 3 coveredinfusiondrugsunderpartD: 4 "(A) Professional services other than nursing 5 services (includingadministrative, compounding, dis- 6 pensing, distribution, clinical monitoring and care 7 coordination services) andallnecessary'supplies and 8 equipment (includingmedicalsuppliessuchassterile 9 tubing and infusion pumps, and other items and 10 servicestheSecretarydeterminesappropriate)toad- 11 minister infusion drug therapies to an individual 12 safelyandeffectivelyinthehome. 13 "(B) Nursing services provided in accordance 14 with the plan, directlyby a qualified home infusion 15 therapyproviderorunderarrangementswithanac- 16 credited homecare organization, in connection with 17 such infusion, except that such term does not in- 18 eludenursingservicestotheextenttheyarecovered 19 ashomehealthsendees. 20 "(2)Forpurposesofparagraph(1): 21 "(A) The term 'home' means a place of resi- 22 dence used as an indi\nduars home and includes 23 suchotheralternate settingsasthe Secretarydeter- 24 mines. •S3505IS — 4 1 "(B) Theterm 'qualifiedhomeinfusiontherapy 2 provider' means any pharmacy, physician, or other 3 provider hcensed by the State in which the phar- 4 macy,physician,orpro\iderresidesorprovidesser\'- 5 ices, whose State authorized scope of practice in- 6 chidesdispensingauthorityandthat 7 "(i) has expertise in the preparation of 8 parenteral medications in compliance with en- 9 forceable standards ofthe U.S. Pharmacopoeia 10 and other nationally reco^ized standards that 11 reofulate preparation of parenteral medications 12 asdeterminedbythe Secretaryandmeets such 13 • standards; 14 "(ii) pro\ades infusion therapy to patients 15 with acute or chronic conditions requiring^par- 16 enteral administration of drug's and biologicals 17 administered through catheters or needles, or 18 both,inahome;and 19 ''(iii) meets such other uniform require- 20 ments as the Secretarv^ determines are nec- 21 essary''toensurethesafeandeffectivepro\ision 22 andadministrationofhomeinfusiontherapyon 23 a 7 da}^aweek, 24 hourbasis (takinginto ac- 24 count the standards ofcare for home infiision 25 therapy established by Medicare Advantage •S3505IS 5 1 plans and in the private sector), and the effi- 2 cient administration ofthe home infusion ther- 3 apybenefit. 4 Aquahfied home infusion providermaysubcontract 5 with apharmacy, physician, provider, or suppherto 6 meettlierequirementsofthissubsection.". — 7 (b)PaymentforHomeInfusionTherapy. Sec- 8 tion 1834 ofthe Social SecurityAct (42 U.S.C. 1395m) 9 is amended byaddingat the end the followngnew sub- 10 section: — 11 "(n) Pa^tvtent for Home Infusion Therapy. 12 The payment amount under this part for home infusion 13 therapyisdeterminedasfollows: — 14 "(1) In gener.\l. The Secretarj^ shall deter- 15 mine a per diem schedule forpayment for the pro- 16 fessional services, supphes, andequipment described 17 in section 1861(hlih)(l)(A) that reflects the reason- 18 able costswhich mustbeincurredbyefficientlyand 19 economically operated qualified home infusion ther- 20 apypro\aders to provide such services, supplies, and 21 equipment in conformity with applicable State and 22 Federal laws, regulations, and the uniform quahty 23 and safety standards developed under section 24 1861(hhh)(l) and to assure that Medicare bene- 25 ficiarieshavereasonableaccesstosuchtherapy. The •S3505IS 6 1 Secretary shall update such schedule from year to 2 year by the percentag:e increase in the consumer 3 price index for all urban consumers (United States 4 city averagfe) for the 12-month period ending with 5 Juneoftheprecedingyear. — 6 "(2) Nursing sermces. The Secretary^ shall 7 develop amethodologv'forthe separate paymentfor 8 nursing services described in section 9 1861(hhh)(l)(B) pro\ided in accordance with the 10 plan under such section which reflects the reason- 11 able costs incurred in the pro\dsion ofnursingsen'- 12 ices in connection with infusion therapy in con- 13 formity with State and Federal laws, regulations, 14 andtheuniform qualityand safetystandards devel- 15 oped pursuant to thisAct and to assure that Medi- 16 care beneficiaries have reasonable access to nursing 17 servicesforinfusiontherapy. TheSecretary^shallup- 18 datesuchschedulefromyeartoyearbythepercent- 19 age increase in the consumer price index for all 20 urban consumers (United States city average) for 21 the 12-montli period ending with June of the pre- 22 cedingyear.". — 23 (e)ConformingAmendments. — 24 (1) Payment reference. Section 25 1833(a)(1) of the Social Security Act (42 U.S.C. •S3505IS — 7 1 13951(a)(1)), as amended by section 101(a)(2) of 2 the Medicare Improvements for Patients and Pro- 3 vidersActof2008 (PubUcLaw110-275),isamend- 4 ed 5 (A)bystriking"and"before"(W)"; and 6 (B) by inserting before the semicolon at 7 the end the follo^\ing: and (X) with respect 8 to home infusion therapy, the amounts paid 9 shallbedeterminedundersection 1834(n)". — 10 (2) Direct payment. The first sentence of 11 section 1842(b)(6) of such Act (42 U.S.C. 12 1395u(b)(6)) isamended— 13 (A)bystriking-"and"before"(H)";and 14 (B) by inserting before the period at the 15 end the following: ", and (I) in the case of 16 home infiision therapy, payment shall be made 17 to the qualified home infiision therapy pro- 18 \ider". 19 (3) Exclusion from durable medical — 20 EQUIPMENTANDHOME HEALTHSER\aCES. Section 21 1861 ofsuch Act (42 U.S.C. 1395x) is amended— 22 (A)insubsection(m)(5),byinserting"and 23 supplies used in the provision ofhome infusion 24 therapy" after "excluding other drugs and 25 biologicals";and •S3505IS — — 8 1 (B) in subsection (n),byadding-attheend 2 the following: "Such term does not include 3 home infusion therapy, other than equipment 4 and supplies used in the provision ofinsulin.". 5 (4) Application of accreditation provi- — 6 SIONS. Thepro\asionsofsection 1865(b) oftheSo- 7 cial SecurityAct (42 U.S.C. 1395bb(b)) applytothe 8 accreditationofqualifiedhomeinfusiontherapypro- 9 viders in the manner they apply to other suppliers. 10 SEC.3.MEDICARECOVERAGEOFHOMEINFUSIONDRUGS. 11 (a)InGeneral.—Section 1860D-2(e)(l)oftheSo- 12 cialSecurityAct(42U.S.C. 1395w-102(e)(l)),asamend- 13 edbysection 182 ofthe Medicare Improvements forPa- 14 tientsand Pro\idersActof2008 (PubhcLaw 110-275), 15 isamended 16 (1)inparagi-aph (1) 17 (A)bystriking-"or" attheendofsubpara- 18 graph (A); 19 (B) by striking the comma at the end of 20 subparagraph (B)andinserting";or";and 21 (C) by inserting before the flush matter 22 follo\\ing subparagraph (B) the follo\^^ng new 23 subparagraph: 24 "(C) an infusion drug (as definedinpara- 25 ^aph(5)),";and •S3505IS 9 1 (2) by adding- at the end the follo"wdng new 2 para^aph: — 3 "(5) Infusion drug defined. For purposes 4 ofthispart,theterm'infusiondrug'meansaparen- 5 teral drug or biological administered via an intra- 6 venous, intraspinal, intra-arterial, intrathecal, epidu- 7 ral, subcutaneous, orintramuscularaccessdevicein- 8 serted into the body, and includes a drug used for 9 catheter maintenance and declotting, a drug con- 10 tained in a de\ice, vitamins, intravenous solutions, 11 diluentsandminerals,andothercomponentsusedin 12 theprovisionofhomeinfusiontherapy.". — 13 (b) InfusionDrugFormularies. Forthefirst2 14 yearsaftertheeffectivedateofthisAct, notwithstanding 15 any other provision oflaw, prescription drug plans and 16 ]\L\-PDplansundertitleX\r[IIoftheSocialSecurityAct 17 shallmaintainopenformulariesforinfusiondrugs(asde- 18 fined in section 1860D-2(e)(5) ofsuchAct, as addedby 19 subsection (a)). The Secretary of Health and Human 20 ServicesshallrequesttheUnitedStatesPharmacopeiato 21 develop, in consultation with representatives ofqualified 22 home inftision therapy pro\iders and other interested 23 stakeholders, amodelformulary'approach forhomeinfu- 24 siondrugsforusebysuchplansaftersuch2-yearperiod. .S3505IS — 10 — 1 (c) Part D Dispensing Fees. Section 1860D- 2 2(d)(1)(B) ofthe Social SecurityAct (42 U.S.C. 1395w- 3 102(d)(1)(B)) is amended by inserting- after "any dis- 4 pensingfeesfor such drugs" thefollowing: ", otherthan 5 foraninfusiondrug". 6 SEC.4.ENSURINGBENEFICIARYACCESSTOHOMEINFU- 7 SIONTHERAPY. — 8 (a) Objectives in Implementation. The Sec- 9 retaryofHealthandHumanServicesshallimplementthe 10 Medicarehomeinfusiontherapybenefitundertheamend- 11 ments made by this Act in a manner that ensures that 12 Medicarebeneficiarieshavetimelyandappropriateaccess 13 toinfusiontherapyintheirhomesandthatthereisrapid 14 and seamless coordination between drug coverage under 15 partD oftitleXM^II ofthe Social SecurityActand cov- 16 erageforhomeinfusiontherapyservicesunderpartB of 17 such title. Specifically, the Secretaryshall ensure that 18 (1) the benefit is practical and workable with 19 minimal administrative burden for beneficiaries, 20 qualified home infusion therapy providers, physi- 21 cians, prescription drug plans, MA-PD plans, and 22 Medicare Advantage plans, and the Secretarv shall 23 considertheuseofconsohdatedclaimsencompassing 24 coveredpart D drugs andpart B services, supplies. •S3505IS
