Effectiveasifinchidedintheen- 7 actmentoftheBalancedBudgetActof1997 (PublicLaw 8 105-33), section 4602(e) ofsuchAct (42 U.S.C. 1395fff 9 note) is amendedbyaddingattheendthefollowingnew 10 sentence: "Notwithstandinganypro\dsionofsection 1891 11 oftheSocialSecurityAct(42U.S.C. 1395bbb)tothecon- 12 trary, the Secretary may only require the submission of 13 additionalinformationunderthis subsectionwithrespect 14 to indi\dduals who are entitled to benefits underpartA, 15 orenroUedunderpartB, orboth, oftitleXVIII ofsuch 16 Act.". 17 (b)ReporttoCongress.—BynotlaterthanOcto- 18 ber1,2001,theSecretaryofHealthandHumanServices 19 shallsubmittoCongressareportonthecoUectionofdata 20 fromhomehealthagenciesonpatientsoftheagenciesthat 21 includesthefoUowing: 22 (1) Recommendations for such legislative and 23 administrative actionsthatthe Secretarydetermines 24 isappropriatewithrespecttothe collectionofinfor- 25 mationbythe Secretaryfrommedicarehomehealth •HR2246IH agencies on patients of such agencies that are not medicarebeneficiaries. (2) Adetermination ofwhetherthe integrityof data collectedpursuant to the Outcome andAssess- ment Information Set (OASIS) is affected by the personal nature ofthe questions posed byreason of suchset. i (3) With resi)ect to the comprehensive assess- ment ofi)atients, a determinationofwhetherthein- tegrity of the data collected would be improved by pro\dding additional time for the completion ofthe comprehensive assessment and the update of the comprehensiveasses1sment. — (c)Definitions. Inthissection: (1) CoiVffREHENSm^ ASSESSMENT OF PA- — TIENTS. The term "comprehensive assessment of patients" means the rule published by the Health Care FinancingAdministration in the Federal Reg- ister on Januar}^ 25, 1999 (64 FR 3784), that re- quires, as a condition of jjarticipation in the medi- careprogram, ahomehealthagencytoproAadeapa- tient-specific comprehensive assessment that accu- rately reflects the patient's current status and that incorporates the Outcome andAssessment Informa- >HR2246IH ensLIBRflRV 4 3 flDIS DDQ1LTL5 S tion Set (OASIS), under section 484.55 oftitle 42 oftheCodeofFederalReflations. (2) Completion op the comprehensive as- — sessment. The term "completion of the com- prehensive assessment" means the standard for the completion of the comprehensive assessment pro- videdundersubsection(b) ofsuchsection. (3) Update op the coMPREiiENsrvE assess- — ment. Theterm "update ofthe comprehensive as- sessment" means the standard for anupdate ofthe comprehensiveassessmentprovidedundersubsection (d) ofsuchsection. (4) Outcome and assessment inpormation — set. The term "Outcome and Assessment Infor- mation Set" means the standard pro\aded under subsection (e) ofsuchsection, relatingto dataitems thatmustbeusedinconductingacomprehensiveas- sessmentofpatients.
