OnSeptember15, 2010, theDepartmentpublished theDraft Environmental ImpactReport (hereinafter "DEIR") and provided public notice in a newspaperofgeneral circulation ofthe availability oftheDEIRforpublicreviewand comment and ofthe date and timeofthe Planning Commissionpublichearingon theDEIR; this noticewasmailed to theDepartment's list of personsrequestingsuchnotice. TheCommissionheld a duly advertised publichearingonsaidDEIRonOctober21, 2010atwhich opportunity forpubliccommentwasgiven, and publiccommentwasreceived ontheDEIR. The period foracceptanceofwrittencommentsended onNovember2, 2010. 3. TheDepartmentprepared responsestocommentsonenvironmental issuesreceived atthepublic hearingand inwritingduringthe45-daypublicreviewperiod fortheDEIR,prepared revisionsto thetextoftheDEIRinresponsetocommentsreceived orbased onadditional informationthat became available duringthepublicreviewperiod, and corrected errorsin theDEIR. Thismaterial waspresented inaDraftComments andResponses document, published onJanuary27, 2011, distributed totheCommissionand all partieswhocommented ontheDEIR, and madeavailableto othersuponrequestatDepartmentoffices. Final Environmental ImpactReporthasbeenprepared bytheDepartment, consistingoftheDraft EnvironmentalImpactReport, anyconsultationsand commentsreceived duringthereviewprocess, anyadditional information thatbecame available, and theSummary ofCommentsandResponsesall asrequiredby law. 5. ProjectEnvironmental ImpactReportfileshavebeen made available forreviewbytheCommission and thepublic.These files areavailable forpublic review attheDepartmentoffices at 1650Mission Street, andarepartoftherecordbeforetheCommission. 6. OnFebruary 10, 2011, theCommissionreviewed and considered theFinal Environmental Impact Reportand hereby doesfind thatthecontents ofsaid reportand theprocedures throughwhichthe Final Environmental ImpactReportwasprepared, publicized, and reviewed complywiththe provisionsofCEQA, theCEQAGuidelines, and Chapter31 oftheSanFranciscoAdministrative Code. 7. Theprojectsponsorhasindicated thatthepresentlypreferred alternative isAlternative C: No ParkingAlternative, described intheFinal Envirorunental ImpactReport. 8. ThePlanningCommissionherebydoesfind thattheFinal Environmental ImpactReportconcerning File No. 2006.1524E, 350MissionStreetreflectsthe independentjudgmentand analysisofthe City and County ofSan Francisco, isadequate, accurate and objective, and thattheComments and Responses documentcontainsnosignificant revisions to theDEIR, andhereby does CERTIFYTHE COMPLETION ofsaid Final Environmental ImpactReportincompliancewith CEQA and theCEQA Guidelines.
