MOVED, That the San Francisco Planning Commission (hereinafter "Commission") hereby CERTIFIESthe Final Environmental Impact Reportidentified as Case File No. 2002.1302E, 2225-2253 Tliird Street (hereinafter "Project") based upon the following findings: 1) The Citv and County ofSan Frmicisco, acting through the Planning Department (hereinafter "Department") fulfilled all procedural requirements ofthe California Environmental Quality Act (Cal. Pub. Res. Code Section 21000 et seq., hereinafter "CEQA"), the State CEQA Guidelines (Cal. Admm. Code Title 14, Section 15000 et. seq., (hereinafter "CEQA Guidelines") and Chapter 31 ofthe San Francisco Administrative Code (hereinafter "Chapter 31"). a. The Department determined that cm Eiivironmental Impact Report (hereinafter "EIR") ^vas recjuired and provided publicnotice ofthat determination by publication in a newspaper ofgeneral circxilation onJuly 22, 2006. b. On April 7, 2007, the Department published the Draft Environmental Impact Report (hereinafter "DEIR") and provided public notice in a ne\vspaperof general circxilation of the availability of the DEIR for public review and comment and ofthe date and time of the Planning Commission public hearing on the DEIR; this notice was mailed to the Department's list ofpersons requesting such notice. c. Notices of availabilit}' ofthe DEIR cmd ofthe date and time ofthe public hearing were posted near the projeci site onApril 7, 2007. CertificationMotion cm' PLANNING COMMISSION File No 2002.1302E Assessor's Block 4058, Lot 10 MotionNo. 17678 Page Two d- On April 7, 2007, copies ofthe DEIR were maileci orotherwise delivered to a list of persons requesting it, to thosenoted on the distribution list in the DEIR, to adjacentproperty o^vners, and to government agencies, the latter both directlv and through the State Clearinghouse. e. Notice ofCompletion was filed with the State Secretary ofResources via the State Clearinghouse on April 6, 2007. 2) The Commission held a duly advertised publichearing on said Draft Environmental Impact Report on May 17, 2007, at which opportunityfor public comment was given, and public comment was received on the DEIR. The period for acceptance ofwritten comments ended on May 21, 2007. 3) The Department prepared responses to comments on environmental issues received at the publichearing and iii writing during the 45-dav p'ublic review perioci for the DEIR, prepared revisions to the text ofthe DEIR in response to comments recei\'ed or based on additional int'ormation thatbecame available during the public revie-\v period, and corrected errors in the DEIR. Tins material ^vas presented in a "Comments and Responses" document, published onJuly 31, 2008, was distributed to the Commission cmd to all parties who commented on the DEIR, and was available to othersupon request at Department offices. 4) A Final En\'ironmental Impact Report has been prepared bv the Department, consisting ofthe Draft Environmental Impact Report, anv consultations and comments received during the review process, anv additional information that became available, and the Comments and Responses document, all as required by law. 5) Project Environmental Impact Report files ha\'e been made a\'ailable for revie^v by the Commission and the public. These files are available for public review at the Department offices at 1650 Mission Street, 4''^ Floor, San Francisco, California, and are part ofthe record before the Commission. 6) On August 14, 2008, the Commission re\'iewed and considered the Final En\'ironmental Impact Report and herebv does find that the contents of said report and the procedures through which the Final Environmental Impact Report was prepared, publicized and reviewed comply w ilh the pro\isions of CEQA, the CEQA Cuitielines and Chapter 31of the San Francisco Admmistiaiive Code. 3 1223 08679 1192 CertificationMotion CITY PLANNING COMMISSION File No 2002 1302E Assessor's Block 4038, Lot 10 Motion No. 17678 Page Tlnee 7) The Planning Commissionhereby does find that theFinal Enviroixmental Impact Report concerning File No. 2002.1302E, 2225-2255 Tliird Street, reflects the indepencient judgment cind analysis ofthe City and Covintv ofSan Francisco, is adequate, accurate and objective, and Ih.it the Comments and Responses document contains no significant revisions to tlie DEIR, and hereby does CERTIFY THE COMPLETION of said Final Environmental Impact Report in compliance with CEQA andthe CEQA Guidelines. 8) The Commission, in certifyingthe completion ofsaid Filial Environmental Imp.ict Repcut, hereby does find that the project describeti in the Environmental Impact Report will have a potentially significant adverse cumulative land use effect due to a possible cc')nsiderable contribution to the loss ofland available for producticjn, distribution and repair (PDR) businesses and jobs. Ihereby certify that the foregoing Motionwas ADOPTED bx the Planning Commission at its regi-ilar meeting ofAugust 14, 2008.
