Where the defendant entered a guilty plea to Criminal Conspiracy to Commit Robbery and Access Device Fraud after urging his girlfriend to steal elderly victim’s purse containing money, credit cards and phone, minimum sentences of 14 months and 6 months, to be imposed consecutively, did not raise a substantial question giving the defendant a right to appeal, because the sentences fell within the sentencing guidelines and terms of the plea bargain, and decision to impose sentences consecutively was not excessive under the circumstances. 2. Even had the defendant raised a substantial question regarding the length of his sentence, giving rise to a right to appeal, Court did not abuse its discretion is sentencing the defendant where sentence fell within guidelines and presentence investigation report indicated the defendant had a long history of criminal activity, violence toward women and substance abuse, for which rehabilitation had been unsuccessful. The appellant, Jose Rivera- Rodriguez, was sentenced to not less than twenty (20) months nor more than eighty-four (84) months in a state correctional institution for his part in the robbery of a sixty-nine (69) year old victim, and the use of her credit/debit cards. The appellant has appealed the discretionary aspects of the sentence, while conceding the sentence was in accordance with the plea agreement and the Sentencing Guidelines. On April 21, 2015, the appellant entered a guilty plea to Criminal Conspiracy to Commit both Robbery1 and Access Device Fraud.2 The appellant directed his girlfriend, Jeniffer Richardson, 1 18 Pa.
