Nil PART I DEPARTMENT OF HOME AFFAIRS & JUSTICE (Home-4 Branch) NOTIFICATION The 8th January, 2018 No. 2/34/2017-5H4/148.-Governor of Punjab is pleased to accord approval for creation of Special Operation Group (SOG) in Punjab Police for acting effectively to neutralize the threat of eventualities like fidayeen attacks, hostage situations, armed infiltration etc. ( 35 ) 22 PUNJAB GOVT. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) [PART I 2. Special Operation Group (SOG) shall have the following details:- I. Objectives of the Special Operation Group Objectives of the Special Operation Group should be as follows:- i) To respond effectively, adequately and in the least possible time with a clear mandate of neutralizing the armed aggressors. ii) To minimize collateral damage in the form of loss of civilian lives and damage to the strategic assets of the country. iii) To have complete coordination with other state players like District Police, Civil Authorities, Army, NSG, IB, Intelligence Wing etc. II. Charter of Duties SOG shall have the mandate to respond in the following situations:- i) Fidayeen Attack ii) Armed infiltration iii) Hostage Situations iv) Kidnapping v) Forced occupation of Vital installation by Armed Militants. vi) Any other case referred by State Government. III. Organizational Structure i) The Special Operation Group shall be headed by an officer of the rank of Inspector General of Police (IGP) who shall be assisted by a Commandant and officials of other ranks. Accordingly, the operational strength of SOG shall be as follows: - Sr. Designation Nos. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) 23 2 Superintendent of Police/ Litigation in 01 37400-67000 + 8700 G.P. the pay scale of commandant 3 Assistant Commandant in 7th IRB in 01 15600-39100 + 7600 G.P. the rank of SP. 4 DSPs (Armed Battalion) 04 15600-39100 + 5400 G.P. 5 Inspectors (Armed Battalion) 04 10300-34800 + 4800 G.P. 6 Sub-Inspector (Armed Battalion) 11 10300-34800 + 4600 G.P. 7 Assistant Sub Inspector (Armed Battalion) 21 10300-34800 + 4400 G.P. 8 Head Constable (Armed Battalion) 45 10300-34800 + 3600 G.P. 9 Constables (Armed Battalion) 188 10300-34800 + 3200 G.P. iii) In order to ensure high quality training for meeting the operational requirements of SOG, DGP is authorized to enlist 4 ASIs, 8 HCs and 8 Constables into Punjab Police, as a special case, against the existing posts of Commando formations from amongst the eligible ex-army/ex-paramilitary personnel. The Non-Gazetted Officers (NGOs) and Other Ranks (ORs) shall have minimum tenure of 5 years. iv) The ministerial staff, Group D and other supporting staff shall be mobilized by Punjab Police from the existing strength of the force. v) Any change in organizational structure will be made with the prior approval the State Government. IV. Operational Composition i) One Squadron of SOG will comprise of three teams consisting of 81 personnel each and each team will be headed by an officer of the rank of DSP. ii) One team will have three hits squads each comprising 27 personnel, headed by an Inspector/Sub-Inspector. iii) Upper age criteria for personnel of the group shall be : ORs-30 years, NGOs- 35 years, Sniper:40. DSP-40 years and SP-45 years. iv) 12 weeks’ rigorous indoor and outdoor probation followed by test evaluation so as to elicit the best fighting material, failure in which shall lead to de-induction. v) Total Operational strength of 1x1 Squadron shall be 274 [SP-1 + R.I.-1+Team Hqr. (12) + 1x3 teams (243) + 2 weapon deptt. (17)]. DGP is empowered to change the operational composition of the squadron and the team. However, the age criteria can be changed with the approval of State Government. V. Eligibility Criteria i) Young, smart, agile and fighting fit men shall form part of SOG. It is imperative that they are robust and full of zeal, dedication and initiative. The personnel from the rank of Constable to Inspector shall be on deputation to SOG. Initially, willing and medically fit personnel from among the Commando formation, PAP and IR Bns, Districts and other units of Punjab Police shall be taken on a probation period of 1x3 months during which they shall be trained in accordance with the SOG training schedule. During the training period they shall draw their existing pay and allowances + TA/DA and free rations. Once the probation period of 1x3 months is over, the men shall be made to undergo mandatory tests i.e. QRs and only those shall be retained who qualify the benchmarks laid down and the rest shall be returned to their respective units. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) [PART I be sought thereafter and the process shall continue. ii) The eligibility criteria for selection into SOG shall be as follows:- Sr. Rank Age Medical Physical Fitness Marksman-ship No. Category 1 SQN CDR 45 years Shape-I PPR & BPET 70% and above Category ‘Good’ 2 Team CDR 40 years Shape-I PPT & BPET 80% and above Category ‘Excellent’ 3 Sniper 40 years Shape-I PPT & BPET 100% Category ‘Excellent’ 4 HIT CDR 35 years Shape-I PPT & BPET 80% and above Category ‘Excellent’ 5 Ors 30 years Shape-I PPT & BPET 90% and above Category ‘Excellent’ iii) DGP is empowered to make any amendment in the above eligibility criteria except the age and medical category, if so required. Any amendment in eligibility criteria of age and medical category, if so required, shall be made with the prior approval of State Government. VI. Training DGP is empowered to decide the period of training, type of training and place of training. In case of foreign training/trainers from other countries, prior approval of State Government shall be taken. VII. Incentives To keep high level of professional expertise and preparedness, exposure to high risk, dedication and maintaining highest level of physical and mental fitness required for this job, the following incentives shall be given for motivating the members of SOG:- i) Posting to the district cadres from Punjab Armed Police (PAP/Indian Reserve Battalion (IRB)/ Commando (CDO) after successful completion of 5 years of tenure in SOG. ii) However, the condition of successful completion of 5 years of tenure in SOG mentioned in para (a) above may be relaxed with the approval of DGP in special cases where the individual sustains disability, either 100 % or partial during any operation, or sustains more than 40% disability during the training to render him unfit for serving in SOG for the remainder of the tenure). Note: Serial No. (a) and (b) above shall come into force after necessary amendment in the Punjab Police Act, 2007. VIII. Weapons & Equipments Weapons, Equipments, Motor Transport & Uniform shall be procured for/provided to the SOG by the DGP as per the existing procedures in place. IX. Uniform Six sets of combatised uniforms shall be provided to all the members of SOG (two per year for three years). To maintain uniformity, the procurement shall be centrally made by a Board of Officers, with co-opted members from SOG to be nominated by IGP (SOG). PART I] PUNJAB GOVT. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) 25 X. Mobility i) For acquiring shortest response time to any given situation, the SOG has to be self-reliant in terms of mobility. Accordingly the following vehicles need to be placed at the disposal of SOG by the DGP from the existing fleet of the Police Department:- 1. Gypsies - 06 2. 52 seater Bus - 05 3. 3 ton trucks - 05 4. Mini Buses (25 seater) - 06 ii) In the event of any contingency the DCs and SSPs will provide the requisite number of additional vehicles to SOG immediately for their effective mobility, if so required. iii) In the event of any contingency, if so required, DGP will tie ups with the Army/Air force authorities to request for the services of choppers/aircrafts for movement of force, weapons & equipments. XI. Control Room Special Operation Group shall share its control room with the existing commando control room. A system of wireless, internet and telephone connectivity shall be put in place for Special Operation Group at commando control room. 3. This order is being issued as per the approval of the Council of Ministers as conveyed vide letter no. 1/167/ 2017-1Cabinet/4925, dated 18.11.2017 by Department of General Administration (Cabinet Affairs Branch). DEPARTMENT OF FINANCE DIRECTORATE OF LOTTERIES PUNJAB STATE NEW YEAR LOHRI BUMPER 2018 NOTIFICATION The 27th December, 2017 No. 8/2(6)/2017/LE-2/5670.–The Governor of Punjab, in exercise of the powers conferred upon him under section 4 of “The Lotteries (Regulations) Act 1998” read with rule 3 of “The Lotteries (Regulations) Rules 2010” and all other powers enabling him in this behalf , is pleased to promulgate the following scheme to conduct a Bumper lottery scheme in the State viz: 1. THE NAME OF THE SCHEME AND THE LOTTERY The Scheme shall be called the “Punjab State New Year Lohri Bumper 2018” and a lottery marketed in the State of Punjab under this scheme shall be called the “Punjab State New Year Lohri Bumper Scheme 2018. 2. NUMBER OF TICKETS The scheme shall have Twenty Lakh lottery tickets with series A and B, series numbering from 000000 to 999999 each. 26 PUNJAB GOVT. The Gross value of the tickets printed shall be Rs. 40,00,00,000/- ( Rs. Forty crore Only). 4. METHOD OF DRAW The following prizes shall be given on the basis of the draw, to be conducted by Director Lotteries or officers deputed by him in this behalf in accordance with the method prescribed against each prize. 1st 2 Rs. If numbers fall from un-sold ticket, lakhs each the machine will be re-operated till the prize is drawn from sold tickets. 2nd 10 Rs. In exceptional circumstance with the prior approval of the Government the said date of draw and venue can be changed. The Director Lotteries will decide the time and venue of the draw. PART I] PUNJAB GOVT. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) 27 7 COMMISSION /INCENTIVES TO BE PAID IN SALE OF TICKETS (a) Commission of Rs. 58.00 (Rs. Fifty Eight Only) per ticket will be given to the agent on the ticket sold. Any commission due shall be paid to the distributor(s) or selling agents out of the money so deposited in the Public Ledger Account or in the Consolidated Fund of the State other depositing 100% payment of the sale proceeds through Bank draft. TDS etc. will be deducted at source while making payment of commission etc. (b) That the agent/distributors shall conduct the business in accordance with the law/ rules and regulations as may be in force in various State/Union Territories of India and shall pay taxes, levies, octroi etc, as may be applicable from time to time. Presently the Central Govt. has introduced GST on lotteries and the same will be paid by the Distributor as per Notifications issued by Govt. of India. Further any other tax on Lotteries imposed by the Central Government/ State Government from time to time will be borne by the distributor/selling agent or as decided. Any commission due shall be paid to the distributor(s) or selling agent(s) out of the money so deposited in the Public Ledger Account or in the Consolidated Fund of the State after 100% payment of the sale proceeds is deposited by them through Bank draft, TDS etc. will be deducted at source while making payment of commission etc. (c) There will be a promoter coupon worth Rs. 300/- each in bundle of 20 tickets. The sellers will be given Rs. 300/- on sale of 20 tickets on surrendering / submitting of the Promoter Coupon. However, this amount of Rs. 300/- will not be given / available, if the seller is getting promoter incentive amount on the basis of a prize winning tickets from that bundle. If there are more than one prizes on one PWT than the seller will only be entitled the highest available incentive. 8 PROCEDURE FOR ISSUE OF TICKETS AND DEPOSIT OF SALE PROCEEDS. i) Any Distributor(s)/Selling Agent(s) for this Lottery scheme will be appointed subject to the condition that they will have to ensure sale of at least 4,50,000 (Four Lakh Fifty Thousand ) tickets in first instance, in case there is a single Distributor/ Agent, if there are two agents the limit of minimum tickets for each Distributor/agent will be 2,25,000( Two lakh twenty five thousand) tickets in first instance and in case there are more than two distributors/agents the minimum limit of lifting the ticket will be 1,50,000 (one lakh fifty thousand) tickets in first instance for each distributor/agent. This department may also appoint more Distributors/ Agents, who will be required to sell at least two lac tickets in the first instance or as decided by the Director. Agreement will be executed by the department with the Distributor/Selling Agent and the department will obtain an agreement signing fee of Rs 10 lac (Rupees Ten lacs) from the distributor/agent in the shape of D.D. in favour of Director, Punjab State Lotteries payable at Chandigarh, which will be adjusted at the time of lifting of tickets by them and in case the distributor/agent fails to lift tickets, this amount of Rs. 10 lac will be forfeited. However, considering the market situation and in the best interest of the state and to increase the sale of tickets, the Director Lotteries may, if deemed appropriate, may increase or decrease this minimum limit of tickets. In order to promote the sale of tickets and in Public Interest, the Department can work out distribution and sale of tickets directly or through District Small Saving Officer, District Small Saving agents or Post Offices in Punjab or any other Department, Semi Government entity, Corporation or Board etc., by offering different rate of commission /promoter coupons and specifying different minimum limits (if any) for lifting of tickets and other suitable terms, to be decided by the Director Lotteries. The delivery of tickets will be given at Ludhiana. The expenditure on sending tickets by post/courier service if demanded by anyone will have to be borne by the concerned distributor/agent. 28 PUNJAB GOVT. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) [PART I In order to make Punjab State Lotteries more popular in other States, the department will explore the possibility of sale of tickets in other States as per the law. Minimum number of tickets to be sold in other States will be decided by Director Punjab State Lotteries and further the Director Lotteries, at his own level will do the appointment of Distributor/Agent for sale the tickets in other States. ii) The Distributor/Selling Agents shall get delivery of tickets by making payment of 100% of the face value in cash/Bank Drafts; Or The distributor/selling agents shall get delivery of tickets on following payment terms: - a. Payment of at least 25% of the face value as Cash /Bank Drafts; and b. 75% by furnishing security in the shape of Bank Guarantee / FDR etc. mortgaged/ pledged in favor of the Director, Punjab State Lotteries, Chandigarh. Validity of the bank Guarantee / FDRs should remain valid for sufficient period. However the balance payment of 75% of face value of tickets sold subject to minimum specified limit as on the date of draw, if any, has to be paid on or before the date of draw, itself through Demand Draft failing which the distributor/agent shall be charged interest @18% p.a, for the delayed period. Interest will be charged on month to month basis. (iii) The tickets will not be issued to the Distributor/Selling Agents if they fail to settle the accounts of any previous lottery scheme within stipulated period. (iv) The request for sending the ticket by post as received in office will not be entertained and the tickets will not be dispatched to the individual customer from office. (v) The tickets shall be issued to the selling agents/distributor as per the procedure laid down in condition 8(ii) above. However full and final payment as per the face value of the tickets so sold shall be paid on or before the date of draw itself through Demand Draft failing which the distributor/agent shall be charged interest @18% p.a, for the delayed period. Interest will be charged on month to month basis. 9. NAME OF AGENTS. Presently following Agents sign the agreement with Government for selling the tickets: i) M/s E-Cool Gaming Solutions Pvt. No.: 0161-2745448,2745449 10 UNSOLD TICKETS The distributor/selling agent will submit the list of unsold tickets, in shape of hard copy and soft copy, subject to the minimum tickets prescribed [in para 8(i)] here to be lifted in the first instance, in the office of PART I] PUNJAB GOVT. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) 29 Director Lotteries up to 12.00 noon on the date of draw and no list of unsold tickets would be entertained by the office after scheduled time. The signed list of unsold tickets can be sent through registered post or through special messenger or email but this Department will not be responsible for any postal delay. 11 PAYMENT OF PRIZES/ INCENTIVES TO PRIZE WINNERS/DISTRIBUTOR/AGENTS (i) All the prize winning tickets above Rs. 5,000/- should reach the office of the Director, Punjab State Lotteries, Vit Te Yojna Bhawan , Plot No. 2-B , Sector 33 A, Chandigarh-160020 on the prescribed form within 30 days from the date of publication of the result in the Punjab State Government gazette either personally or through a nationalized bank or by registered post or by insured parcel. (ii.) Sellers’ and Sub- Agents’ promoter incentive up to Rs. 1,000/- should be claimed from the Distributor(s)/ Selling Agent(s) within 30 days from the date of publication of the result in the Punjab State Government Gazette and the promoters prizes above Rs. 1,000/- should be claimed directly from the Director, Punjab State Lotteries Vit Te Yojna Bhawan, Plot No. 2-B , Sector 33 A, Chandigarh-160020 within 30 days from the date of publication of the result in the Punjab State Government gazette. The Distributor/ Agent(s) promoter incentive may be claimed from the Director Punjab State Lotteries directly. TDS will be deducted at source while making payment of such incentive(s). (iii) In case the prizewinners claim does not reach this Directorate within 30 days, the right of the winner to claim the prize/amount thereafter shall be extinguished in accordance with the Punjab State Lotteries Rules 2015. The Director or the State Government, as the case may be, may in exceptional circumstances and on sufficient cause being shown, condone the delay in submission of claim after the prescribed 30 days in accordance with the rules ibid. Distributor/Agents are authorized to make the payment of prizes/incentives below above said limit and seek reimbursement from office within 90 days from the date of publication of the result in the Punjab State Government gazette. 12 LEGAL JURISDICTION The legal jurisdiction of this lottery shall be only at Chandigarh. 13 OTHER IMPORTANT CONDITIONS OF THE SCHEME i) The draw for the prizes will be held out of the total scheme. However, the draw of first prize(s) will be out of sold tickets only. ii) Income Tax on prizes / incentive(s) to sellers etc., wherever applicable, shall be deducted at source irrespective of the fact whether the prize goes to the winners, distributor(s)/selling agent(s) or seller(s). iii) Promotional publicity will be got done through the Directorate Public Relation Department Punjab , Chandigarh on the DAVP/DPR rates through the mode of T.V., Radio, newspapers, banners, hoardings etc. Therefore, a provision of Rs 50.00 lacs (Rupees Fifty lacs only) is made for advertising through T.V, Radio, Newspapers and hoardings etc. and Rs. 10.00 lacs (Rupees Ten lacs only) for printing of tickets, coupons etc. Distributors/Agents may be allowed to make publicity through banners and cassettes, the rates/criteria of which will be approved by the Designated Authority. iv) GST imposed by the Government of India on Lotteries will be borne by the Distributor/ Selling Agent. v) Distributor(s)/Selling Agent(s)/ Sub Agents and sellers are advised to check the correctness of the printing and numbering of the tickets before selling and buyers should also check the same before purchasing tickets. Defective tickets should not be sold to the public, but should immediately be returned to the issuing authority vi). A ticket, which is forged, torn out, mutilated or tampered with shall not be entertained. 30 PUNJAB GOVT. GAZ., JANUARY 12, 2018 (PAUSA 22, 1939 SAKA) [PART I vii). Prize will be paid on the production of original tickets only. viii) Prize winning tickets holders abroad will be paid in Indian currency as per scheme. ix) One ticket/coupon will be eligible to only one incentive viz. The highest incentive drawn against it. x). In case of any dispute, the decision of the Principal Secretary to the Government of Punjab, department of Finance shall be final and binding. xi). Before submitting the claim, results may be Checked with the Punjab State Government Gazette. xii) The request for sending the tickets by post as received in the office will not be entertained and the tickets will not be dispatched to the individual customers from office. xiii) The provisions of ‘The Lotteries (Regulation) Act 1998' and ‘The Lotteries (Regulations) Rules, 2010 and Punjab State Lotteries Rules 2015' shall be applicable. 14 AMENDMENTS TO THE SCHEME The Government of Punjab may at any time amended/ delete/ modify/ relax any of the provisions of the Scheme under the orders of the Principal Secretary Finance, Government of Punjab in exceptional circumstances without assigning any reasons(s). Prizes will be paid after deducting the tax as applicable. ) 2 METHOD OF DRAW The following prizes shall be given on the basis of the draw, to be conducted by Director Lotteries or officers deputed by him in this behalf in accordance with the method prescribed against each prize. 1st 2 Rs. One Two complete numbers will be drawn along with series. One from Prize Crore fifty series A and another from series B. If numbers fall from un-sold ticket, lakhs each the machine will be re-operated till the prize is drawn from sold tickets. 2nd 10 Rs. Ten lakh Ten numbers of six digit will be drawn with series. each 3rd 10 Rs. Five Lac Ten numbers of six digit will be drawn with series. each 4th 20 Rs. One lakh Ten numbers of six digit will be drawn without series. each (Common to both series).
