The Orissa G a z e t t e EXTRAORDINARY PUBLISHED BY AUTHORITY No. 90 CUTTACK, MONDAY, JANUARY 30, 2006 / MAGHA 10, 1927 LABOUR & EMPLOYMENT DEPARTMENT NOTIFICATION The 12th January 2006 No. 340—Ii/1(B)-17/1993-LE.–In pursuance of Section 17 of the Industrial Disputes Act, 1947 (14 of 1947), the Award, dated the 7th December 2005 in Industrial Dispute Case No. 27 of 1995 of the Presiding Officer, Labour Court, Bhubaneswar to whom the industrial disputes between the Management of Magnetix (India) Limited, Bhubaneswar and its Workman Shri Nakul Charan Biswal represented through Magnetix (India) Workers Union, Bhubaneswar was referred for adjudication is hereby published as in the Schedule below : SCHEDULE IN THE LABOUR COURT, BHUBANESWAR INDUSTRIAL DISPUTE CASE NO. 27OF 1995 Dated the 7th December 2005 Present : Shri P. K. Sahoo,O.S.J.S. (Jr. Br.) Presiding Officer, Labour Court Bhubaneswar. Between : The Management of . . First Party—Management Magnetix (India) Limited Bhubaneswar. And Its Workman . . Second Party—Workman Shri Nakul Charan Biswal represented by Magnetix (India) Workers Union, Bhubaneswar. Appearances : For both the Parties . . None 2 AWARD The Government of Orissa in the Labour & Employment Department in exercise of powers conferred upon them by sub-section (5) of Section 12, read with clause (d) of sub- section (1) of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) have referred the following dispute for adjudication vide their Order No. 1448—Ii/1(B)-17/1993-LE., dated the 28th January 1995 :— “Whether the termination of services of Shri Nakul Charan Biswal by the management of Magnetix (India) Limited, Bhubaneswar with effect from the 20th January 1992 is legal and/or justified ? If not, to what relief Shri Biswal is entitled ?” 2. The concerned workman is absent on repeated calls. No steps taken on his behalf. The case is posted to-day for hearing. No prayer is also made by the either party to adjourn the case to some other date for hearing. On perusal of the case record, it is seen that the workman has been remained absent since the 19th May 2003. Since the workman concerned is absent to-day, a “No Dispute Award” possible is passed accordingly. Dictated and corrected by me. P. K. SAHOO P. K.
