Engebretsen / 2401 SW 26th Avenue. Attached for your review is an application from Bjorn E. Engebretsen / 2401 SW 26 Avenue (see Exhibit 1). APPLICATION AND BACKGROUND INFORMATION The applicant is seeking to install a new marginal dock extending a maximum of 7.83’ into the South Fork of the New River from the property line. As the property line is in the water (submerged), the proposed dock would extend a maximum of 27.5’ from the bulkhead. The distances this structure extends from the bulkhead into the South Fork of the New River are shown in the survey in Exhibit 1 and summarized in Table 1 below: TABLE 1 PROPOSED STRUCTURE PERMITTED DISTANCE REQUIRING STRUCTURE DISTANCE FROM DISTANCE WAIVER BULKHEAD WITHOUT WAIVER Marginal Dock 27.5’ 5’ 22’ The City’s Unified Land and Development Regulations (UDLR), Section 47-39 A.1.b.12(a.) (Exhibit 2) limits the maximum distance of the dock at this location to 5’. Section 47.19.3.E authorizes the City Commission to waive that limitation based on a finding of extraordinary circumstances. The applicant’s summary description includes the following justifications: 1. Curvature of the property’s seawall would require a 5’ wide curved dock. 2. Hazardous exposed footer and damaged seawall adjacent to seawall at low tide. 3. Shallow water depths adjacent to seawall restricts dockage. 4. Proposed plan with proposed vessel within 30% allowable dock/vessel distance. 5. Proposed plan would encourage reduced speed of passing vessels in this area. 6. Majority of proposed dock is within property line. Marine Advisory Board June 16, 2015 Page 2 PROPERTY LOCATION AND ZONING The property is located within the Palm Grove Acres RS-3.52 One Family Detached Dwelling District. It is situated on the northern shore of the South Fork of the New River where the overall width of the waterway is identified as approximately 212’. The ULDR code requirements for the annexed Riverland Road area are more restrictive than the requirements through-out the rest of the City, limiting the maximum distance of a dock at this location to 5 feet, as opposed to 25 feet or 25%, whichever is less, elsewhere in the City. Specifically, Article XV, Annexed Areas, ULDR Sec. 47-39.A.1.b.12.a, states, “No dock shall project more than five (5) feet into any waterway beyond the property line along the waterway or the established bulkhead line. No dock shall extend closer than ten (10) feet to the plot line of any other residentially-zoned property.” DOCK PLAN AND BOATING SAFETY Marine Facilities’ records reflect that there has been 1 waiver of docking distance limitations within close proximity approved by the City Commission in recent years as represented in Table 2: TABLE 2 DATE ADDRESS MAXIMUM DISTANCE th 2012 2341 SW 26 Avenue 6’ RECOMMENDATIONS Should the Marine Advisory Board consider approval of the application, the resolution under consideration for approval by the City Commission should include at least the following as prescribed in the ULDR and City Code of Ordinances: 1. The applicant is required to comply with all applicable building and zoning regulations as well as any other Federal and State laws and permitting requirements including the Broward County Environmental Protection and Growth Management Department and the U.S. Army Corps of Engineers. 2. As a general condition of approval and in order to review for final consistency with construction of facilities in accord with this application and City building permits the applicant is required to provide the appropriate City staff with copies of “As Built” drawings from a certified and licensed contractor, and verification of receipt of all applicable Federal and State permits.
