DRANE BURDICK[Resumed]: 16 Q Good morning. Today's date is July 29th, 17 2009. And this is the continuation of the deposition 18 of Cynthia Marie Anthony. Mrs. Anthony, you've been 19 sworn again this morning; correct? 20 21 A Yes. 22 Q Okay. I'm going to ask you just the same 23 basic questions that I did at the beginning of the 24 deposition yesterday. Are you today under the 25 influence of any drugs or alcohol? 187 1 A Just my prescription medicine. 2 Q All right. Like I asked yesterday, do you 3 feel that that is affecting your ability to understand 4 what's happening here today? 5 A No. 6 Q And do you feel comfortable answering 7 questions? 8 A Yes. 9 Q Okay. If there is something that I say that 10 you don't understand, you will interrupt me and let me 11 know that; correct? 12 A Yes. 13 Okay. Have you eaten and slept since last 14 night? 15 A I didn't sleep real well last night. 16 Q Okay. 17 A But I did have some Instant Breakfast this 18 morning, which is all I can do in the morning. 188 Q R i g h t . Q 19 A So -- 20 Q Do you -- 21 A As good as it gets. 22 Q All right. Do you feel, even though you 23 didn't sleep that good last night, that you've had 24 sufficient sleep to proceed forward with the 25 188 deposition? 2 A All I can say is I'm as good as I am in the 3 morning so -- 4 Q Okay. I was advised that there were times 5 yesterday when you and I would talk over each other. 6 So that makes it difficult for the court reporter to 7 transcribe the proceedings. So if you -- and I'll do this as well. If you can wait until I finish asking a 8 9 question, you might think that you know where I'm going 10 and start answering, but just for her sake, if nothing 11 else, if we could try to be cognizant of the fact that we're doing that to each other. 12 13 Additionally, since this is an audio record, 14 we have to answer yes and no. A lot of times people will say uh-huh/huh-uh, which when you're looking face 15 to face, it's apparent that it's a yes or a no 16 response. Since we don't have video, in the audio she 17 might be here, make a notation that that was an 18 19 affirmative response just so there's no question later 20 on, if it is an issue, that you said yes or you said no 21 in response to a certain area of questioning; okay? 22 A Okay. 23 Q All right. Yesterday in asking some of the 24 questions about the cellphones, you had indicated that 25 sometime last summer Lee had purchased, you think 189 through AT&T, what you all were referring to as Bat 2 phones -- 3 A Uh-huh. Yes. 4 Q diSposable phones that you could talk to 5 each other on because there was some concern about your 6 home phone being tapped? 7 A Our cellphones. 8 Q Cellphones as well? 9 A Uh-huh. 10 11 All right. 12 A Yes. 13 Now, you had Lee's Bat phone number as 14 407/432-0624 in your phone. Do you remember yours? 15 A No. 16 17 Q Last night did you have an opportunity to try 18 to look for any of that information? 19 20 A No. The phone is not charged. I don't, you 21 know -- 22 Q Okay. How about -- you said Casey had a Bat 23 phone -- 24 A Yes. 25 Q -- as well? Do you recall the number that -A No. you would use? Q -- A I don't remember phone numbers. 11 90 Q Okay. Is the same true of George? 2 A Yes. 3 Q I had asked you, I believe, if Dominic Casey 4. had a -Bat phone. 5 A Correct. 6 Q Okay. And you said no? 7 A That's correct. 8 Q Did you know him to have more than one 9 cellphone? 10 A I believe he did. 11 Q All right. Did you call him on more than one 12 cellphone? 13 A Yes. 14 15 Q Do you have those cellphone numbers? A I think I have one cellphone for him. 16 Because, again, my phone died on Monday and we could 17 only retrieve what was saved to my SIM card. Not all 18 19 the numbers were on my SIM card. 20 Q Okay.
