ORGANIZATIONAL PROTOCOLS AND PROCEDURES  JUNE ‐ AUGUST, 2012      The Department of Elder Affairs (the “Department”), in consultation with the Agency for  Health Care Administration, the Department of Children and Families, and the Department  of Health, intends to utilize negotiated rulemaking as a means for rule development.  This  process focuses on fostering the collaboration of a representative stakeholder committee to  reach a consensus‐based agreement that will be translated directly into a proposed rule.   The following organizational protocols and procedures govern this negotiated rulemaking  proceeding.    1.  GOAL      The goal of the Negotiated Rulemaking Committee is to reach consensus on proposed  rules regulating assisted living facilities.  The proposed rules may take the form of an  outline or actual draft language including repeal, amendment, or proposed new text.   The subject areas for rulemaking are identified as:        Educational Requirements, Training, and Competency Exams for       Administrators and Managers;      Training for Staff;      Core Trainers;      Training Accessibility;      Data Collection;      Medication practices;      Emergency management;      Licensing and services provided for limited nursing services, limited mental      health, and extended congregate care designations;      Deletion of duplicative rules; and,      Revision of rules as needed based on legislative changes.    2.  GOOD FAITH NEGOTIATION      All participants agree to act in good faith in all aspects of these negotiations.  The  effectiveness of this consensus‐based process depends upon the fact that it is voluntary,  informal and flexible in nature.  Participants must be willing to explore ways to reconcile  competing and conflicting interests.  Participants represent stakeholder groups or  interests, and not simply themselves.  Specific offers, positions, or statements made  during the negotiations may not be used for any purpose outside the negotiations as the  meetings and discussions are intended to be in the nature of settlement discussions. It is  the intent of the Negotiated Rulemaking Committee that this provision be voluntarily complied with by all parties in order to support the consensus decision‐making process  by encouraging the free and open exchange of ideas, views, and information.       The Department retains the sole responsibility to promulgate the final rules and intends  to promulgate the final rules based on the agreed rules reached by consensus of the  Negotiated Rulemaking Committee.  The promulgation of the final rules are subject to  both public comment in the proposed rule stage of rulemaking and to additional  information that the Department is required to consider, including comment of the Joint  Administrative Procedures Committee.    3.  COMMITTEE PARTICIPATION      All members of the Negotiated Rulemaking Committee have equivalent status.   Negotiated Rulemaking Committee members are listed on Attachment 1.    3.1.  ATTENDANCE – Committee members are expected to attend all regularly  scheduled meetings of this Negotiated Rulemaking Committee and be present at  such time as sessions are called to order. Absences may be planned (due to a  conflicting personal or professional obligation that cannot be reasonably altered) or  unplanned (e.g. sudden illness, accident, injury, or other unanticipated event). In  either case (including anticipated tardiness to a Committee meeting) Committee  members are expected to notify Department or Agency staff by email or telephone  as soon as practicable before the meeting begins (see Attachment 2).    3.2.  PROXY – No participation by proxies or alternates for Committee members is  permissible.      3.3.  ADDITIONAL COMMITTEE MEMBERS ‐  Additional Committee members may be  added by application to the Department as set forth in the Notice of Development of  Rulemaking published in the Florida Administrative Weekly dated May 11, 2012.   However, it is the intent that the Negotiated Rulemaking Committee be kept to an  optimal number of participants in order to allow for efficient collaboration.      4.  FACILITATOR      A neutral and impartial facilitator will be engaged by the Department; however, the  facilitator acts independently of the sponsoring agency.  The facilitator is accountable to  all members and manages the negotiated rulemaking process.  The facilitator chairs the  Committee’s meetings, sets the pace and tone of negotiations, ensures that each party  has a full opportunity to be heard, and helps the Committee to finish its tasks in a timely  manner.  The facilitator ensures that the protocols and procedures are carried out,  points out when they are not being followed, and seeks to remedy problems.  In  managing the process, the facilitator may suggest ideas to stimulate debate or  circumvent impasses, and may encourage parties to move toward each other.  The  2 facilitator has ultimate oversight responsibilities and complete discretion in making  decisions affecting the collaborative agreement‐seeking process.      At the conclusion of the negotiated rulemaking proceeding, the facilitator will prepare a  report summarizing the proceeding and submit it to the Department’s Legal Staff  Support.    5.  DECISIONMAKING BY THE COMMITTEE     5.1.  QUORUM – A duly noticed Negotiated Rulemaking Committee meeting shall be  convened when at least two‐thirds of the total members are present at the meeting.   A roll call of members in attendance shall be taken and the meeting shall be called to  order if a quorum is present.     5.2.  CALL FOR VOTING – A Committee member may make a motion to close  discussion and call for a vote.  A second of the motion is required.  A simple majority  vote of committee members present is required to pass a motion to close discussion  and call for a vote.  The facilitator, in his or her sole discretion, may independently  close discussion and call for a vote without the requirement of making a motion.     5.3  CONSENSUS VOTE – A consensus on a proposed rule is reached when two‐thirds  of the members present agree that their major interests have been taken into  consideration and addressed in a satisfactory manner.  Furthermore, members must  also agree that given the combination of gains and trade‐offs and given the current  circumstances and alternative options, the resulting agreement is the best one the  Committee is likely to make.  A consensus is evidenced by an affirmative two‐thirds  vote of eligible Committee members in attendance at the particular meeting in which  the vote is taken on a proposed rule.    5.4  FAILURE TO REACH CONSENSUS ‐ If the Committee is unable to reach consensus  on a proposed rulemaking, the Department, in its sole discretion, may consider the  deliberations presented during the meetings in drafting rules addressing that subject  matter in any subsequent rule development proceeding.    6.  INTERNAL ORGANIZATION       The proceedings of the Negotiated Rulemaking Committee will not be electronically  recorded, but draft summaries of Committee meetings will be prepared by the facilitator  with the assistance of Department staff for the convenience of Committee members.  Such summaries shall not be construed or taken to represent the official position of the  Negotiated Rulemaking Committee or any member on what transpired at a Committee  meeting.  A proposed agenda for each meeting will be prepared by the facilitator with  the assistance of Department staff for posting prior to all regularly scheduled Committee  meetings.  Current information about the meetings, including agendas, meeting  3 summaries, notices, and the results of voting will be posted and accessible at the  Department’s Assisted Living Facility Rulemaking website located at this address:  http://elderaffairs.state.fl.us/doea/alf_rulemaking.php.    7.  OPEN MEETINGS     Meetings of the Negotiated Rulemaking Committee shall be open to the public, however  participation in the discussion at Committee meetings will be limited to duly‐qualified  Committee members or as otherwise determined by the facilitator.  A request for public  testimony may be considered by the facilitator but will not generally be granted as public  testimony has been substituted with member representation in this rule development (a  rule development that utilizes a consensus‐based negotiated rulemaking method for  drafting proposed rules).   Committee members are encouraged to make themselves  available at reasonable times (other than during convened meeting times) to discuss the  ideas, concerns, and suggestions of interested parties subject to Florida’s Sunshine Act.   The facilitator may request the removal of any person whose behavior is causing a  disturbance to the work of the Committee.    8.  COMMUNICATIONS      Out of respect for the process and all participants and observers, while a meeting is in  progress, please refrain from the use of electronic communications devices.  Periodic  breaks will be scheduled during the meetings to allow for the use of communications  devices and for communications between members of the public and Committee  members.   4 ATTACHMENT 1
